Fresh tariff war on cards: Shyam-Sistema launch cell service Tue, Sep 30 2008. 5:16 PM IST Press Trust of India Mobile telecom tariffs may see another fierce battle as one of the new telecom operators Shyam Telelink, in partnership with Russian giant Sistema, started its pan-India service from Rajasthan and offered local calls and SMS for just 50 paise a minute. Besides, Shyam-Sistema is also offering bundled handset for Rs999 with lifetime validity. “The tariffs can fall further if the telecom regulator TRAI makes the termination charge cost based, which would be less than 10 paise a minute from current 30 paise and same can be passed on to the customers,” Shyam Group promoter Rajiv Mehrotra said. Termination charge is paid by a service provider to other operators on whose network the call terminates. Even state-owned BSNL had earlier said that termination charge is due for review for long time, and in its absence, the existing operators are getting undue advantage at the cost of millions of subscribers. The services launched under Rainbow brand would offer free calls between the same network for first six months, he said, adding the company would announce various new schemes and offers in the coming months. Shyam Telelink-Sistema is the first operators among nine companies, who have been given new licences in 2008, to start services. The company is planning to start services next in the Southern region. Mehrotra also asked TRAI to ensure that new operators get cost-based mandatory inter-connection from the existing service providers. Shyam Telelink-Sistema has pan-India CDMA licence and was the first company to get spectrum across the nation. Sistema is the majority partner with 74% stake in the joint venture (JV). Launching the services, Chairman of Sistema Vladimir Evtushenkov said: “We consider India as one of the most attractive markets with high potential of growth. This is in line with our global strategy to enter rapidly developing markets and integrate Sistema in the global community.” “Further, India and Russia have traditionally shared a great relationship. Thus, our foray in the country is very logical in terms of furthering the relationship between the two countries,” he added. Shyam Telelink Chairman Vitaliy Savelyev was visibly pleased with the speed of implementation of their plans in the country. Savelyev said: “The Indian telecom space has witnessed tremendous growth in the past couple of years, and we see the trend continuing.” Earlier, Sietema had announced an investment of $5 billion in India, majority of which was for the telecom sector.

Reliance Communications’ plea against Andhra tax dismissed September 30th, 2008 - 12:04 am ICT by IANS The Supreme Court Monday dismissed a lawsuit by Anil Ambani-promoted Reliance Communications challenging an Andhra Pradesh High Court order asking it to pay the state government one-third of the Rs.430 million value added tax (VAT) imposed on the sale of its recharge vouchers.A bench headed by Justice S.B. Sinha dismissed the lawsuit and asked the high court to dispose of within four weeks the company’s plea against the state government order for imposing VAT on its recharge vouchers and various value added services. The high court had asked Reliance Communication to first pay one-third of its tax liability to the government before Sept 30. It said it would adjudicate its plea only after the money was paid. The Andhra Pradesh government has imposed 4 to 12.6 percent VAT on Reliance Communication mobile telephone recharge vouchers and various types of value-added services provided by it. Though a single bench of the high court suspended the recovery of tax from Reliance, a division bench of the same court modified the order and turned it into an interim stay. The bench ruled that the interim stay would continue only if Reliance paid one-third of its tax liabilities on or before Sep 30 and that the order would stand cancelled in case the company defaulted. Reliance challenged the levying of the tax, contending its get-started-kit (GSK) was like a recharge voucher and was meant to activate the account and connection of a subscriber. It contended that like recharge vouchers, GSKs become waste paper after activation of connection and, therefore, were identical to recharge vouchers. Hence, they could not be treated as “goods” on which VAT is imposed, the company maintained. Recharge vouchers and GSKs cannot be considered to be “goods” as these only served as an advance collection mechanism for the fee charged by the service provider and would not fall within the meaning of “goods” as defined in the Andhra Pradesh VAT Act, Reliance contended. Similarly, value added Services like SMS, ringtones and games were pure services and thus, beyond the definition of the term “goods”, the company said.

Centre orders IPTV players to carry 8 DD channels Monday, September 29, 2008 03:59 IST DNA India NEW DELHI: The government has significantly increased the number of TV channels to be compulsorily carried on IPTV (internet protocol television) platforms. In a memorandum issued to all IPTV owners, the information and broadcasting (I& ministry has listed eight, including Doordarshan and Parliament channels, on the must-carry list. The other must-carry channels are Lok Sabha Television, DD Rajya Sabha, DD-1 or national channel, DD News, DD Sports, DD Urdu, Gyan Darshan and DD Bharti. Cable TV operators, as per the Cable TV Network Regulation, are supposed to air at least two DD terrestrial channels, two Parliament channels and one regional channel — a total of five. As for direct-to-home (DTH) players, it is mandatory for them to have at least four channels—two DD and two Parliament channels—on their platforms. Sujata Dev, co-founder of IPTV Forum, an industry body, said the government has asked IPTV players to carry more state-owned (DD) channels because of the general perception that there’s no bandwidth restriction here, unlike in DTH or cable TV. While admitting that relatively there’s less restriction on bandwidth in IPTV, she said every channel takes up around 2MBPS. “We are going to approach the government on this issue,” said Dev. This is not the only issue that IPTV players are grappling with. There’s no clarity on pricing of channels in IPTV either, she added. Also, the recent consultation paper of the telecom regulator, Trai, on restricting cross-media ownership may also pose a hurdle, she argued. Many players may like to wait and watch the government move on cross-media ownership rules before commercially launching their IPTV ventures, she argued. On an average, an IPTV platform is expected to have anything between 100 to 200 channels. Last month, the government made IPTV a lawful broadcasting operation. Till then, IPTV has been in a no-man’s land, and its regulation a grey area. State-owned telcos, Bharat Sanchar Nigam Ltd (BSNL) and Mahanagar Telephone Nigam Ltd (MTNL), commercially launched their IPTV services a few months ago. But, they have been facing problems in accessing content from registered broadcasters, in the absence a policy framework. Among the private players, Bharti and Reliance Communications have conducted their IPTV pilots across many cities, but they are yet to commercially launch the service. IPTV refers to a distribution platform using high-speed internet, to offer TV channels along with many interactive and value-added services. For instance, an IPTV subscriber can pause a live show, record it and watch it later. TRAI had earlier this year recommended that uplinking and downlinking guidelines should be amended to enable broadcasters to provide signals to all distributors of TV channels including IPTV service providers.

Post MNP, subscribers can swap between GSM and CDMA services while retaining number Economic Times | New Delhi | 27 Sep 2008 The department of telecom (DoT) has made significant changes in the mobile number portability (MNP) norms to allow customers move between GSM and CDMA services provided by the same operator. As per the earlier norms, customers could move to a different operator and retain their number. But following the amendment, a customer will now be allowed to shift to different technology platform offered by his own operator and still retain his mobile number. The move is set to benefit Reliance Communications (RCOM), Tata Teleservices, and state-owned players, BSNL and MTNL. RCOM and the Tatas now offer pan-India mobile services on the CDMA platform. They are now all set to launch GSM operations within the next couple of months. BSNL and MTNL, which currently offer GSM services, are rolling out full-fledged services on the CDMA platform. ET has learnt that telecom minister A Raja had cleared this amendment on September 23. DoT has also inserted a clause mandating that revenues to the government must not be impacted, when a telco moves a customer from its CDMA to GSM network or vice-versa. In another significant change, DoT has now said if an subscriber is shifting from GSM to CDMA or vice-versa within the same service provider, then the process need not be routed through a centralised agency. “They can set up their own database and execute the process, bypassing the centralised operator,” said sources close to the development. But as per the MNP guidelines unveiled by Mr Raja in August, all porting must be routed only through two centralised operators who will be chosen by DoT. The norms add these centralised operators will become mobile number portability clearing house administrators (MCHAs) and will set up the number portability database (NPDB), which will have the mobile numbers of all cellular users. All service providers will have to link their networks with MCHA and NPDB. Industry sources said dual technology players, operators who offer services on both GSM and CDMA, would be the biggest beneficiaries. “The DoT plans to allow this facility even before the actual MNP, including all operators, is implemented. This may help CDMA players, provided they rollout their GSM platform before MNP comes into effect. Under the actual MNP, the customer can move to any operator. However, the dual tech operators can now give their customers the flexibility to move to another technology platform even before MNP kicks off across all operators. Thus, they get to retain their subscribers who want to move to a new technology platform,” said industry sources. Market surveys have shown that 25-50% of the mobile users in India are unhappy with their operator, and are willing to switch to another service provider if allowed to retain their number.

Reliance Communications to launch GSM services in Bangalore by December Business Standard - September 24, 2008, 0:39 IST Reliance Communications, an integrated telecom operator, has commenced testing of its soon-to-be-launched GSM (global system for mobile) network in Bangalore. The company is in the process of launching nationwide GSM services in addition to its CDMA services which are available across 20,000 towns and 450,000 villages in the country. In the first stage of testing, RCom has issued over a thousand GSM SIM cards to its employees. The second phase of its "soft trial" is expected to start within six weeks from now where the company will start offering services to its channel partners and select subscribers before commercial launch. Reliance Communications has pumped in Rs 300 crore in setting up its GSM network in Bangalore where it has installed 1,600 tower sites. Airtel, the largest operator in Bangalore, with close to 2 million GSM subscribers has 1,200 cell tower sites presently. The total number of GSM subscribers in Bangalore is estimated to be around 5 million. Reliance Communications has also installed Indoor Building Network solutions in over 250 buildings in Bangalore including airports, 5-star hotels, shopping malls and major business hubs. The indoor solutions would improve the network coverage quality and coverage within the buildings. Reliance Communications spokesperson said, "The nationwide GSM rollout of Reliance Communications is progressing as planned and is presently in its advanced testing stages. The nationwide GSM launch is slated to commence from end-2008."
