U.S. to sue Apple, 5 e-book publishers in collusion case Source The Justice Department has warned Apple and five major U.S. publishers that it plans to sue them, accusing them of colluding to raise the prices of electronic books, a person familiar with the probe said on Thursday. Several parties have held talks to settle the potential antitrust case, said the person, who was not authorized to speak publicly on the matter. It is not yet clear what such a settlement might look like. The five publishers facing possible Justice Department action are Simon & Schuster Inc., a unit of CBS Corp ; Lagardere SCA's Hachette Book Group; Pearson Plc's Penguin Group (USA); Macmillan, a unit of Verlagsgruppe Georg von Holtzbrinck GmbH; and HarperCollins Publishers Inc., a unit of News Corp. U.S. and European officials have been investigating whether publishers and Apple acted together to drive up prices in the booming electronic book industry, blocking rivals such as Amazon from offering cheaper e-books. Antitrust rules forbid price-fixing agreements designed to shut out competitors or drive up what consumers pay. E-book publishers adopted an "agency model" in 2010, about the time that Apple launched the iPad. That model allowed publishers to set the price of e-books and in turn, Apple would take a 30 percent cut. The Apple agreements with publishers effectively barred them from allowing rival retailers to sell the same books at lower prices. The strategy upended the "wholesale model" in which retailers pay for the product and charge what they like. Amazon , which got a headstart in the e-book market with its Kindle e-reader, had used the wholesale model to generally charge $9.99 for its e-books. The Wall Street Journal first reported the Justice Department's lawsuit warning to Apple and the publishers. An Apple spokeswoman declined to comment, as did a Justice Department spokeswoman. HarperCollins and MacMillan did not immediately respond to requests for comment. Penguin and Simon & Schuster declined to comment. Hachette Books chief Arnaud Nourry said yesterday that he was not going to comment on ongoing legal proceedings. "We have obviously decided to cooperate with the authorities on both sides of the Atlantic, and we believe that we have committed no objectionable acts." Private suit Apple and the publishers face a parallel class-action lawsuit now in a Manhattan court that was brought on behalf of e-book customers. The class-action suit, filed last year by law firm Hagens, Berman, Sobol, Shapiro, LLP, accuses Apple of being a "hub" for collusion. Jeff Friedman, a partner at Hagens Berman who helped file that suit, said it was prompted by a sudden increase in the price of e-books that was not matched by any cost increases. "The case is about ... a radical industry shift that simultaneously resulted in a 30 percent to 40 percent price increase across the industry overnight," Friedman said. Apple asked the court last week to drop the class action suit, saying it did not collude with a group of publishers. "Before Apple entered the eBook market, one competitor, Amazon, the nation's largest bookseller, had taken 90% of the market by pricing key eBooks below their wholesale cost," Apple said in the filing. "Having no desire to incur the losses that would flow from retailing in such an environment, Apple individually negotiated separate vertical agreements with each of the publishers to serve as a distribution agent in exchange for a 30% commission on eBook sales," the company said in its motion. Digital growth The e-book industry has exploded in recent years, growing from $78 million in sales in 2008 to $1.7 billion in 2011, according to Albert Greco, a book-industry expert at the business school of Fordham University. Greco estimates e-book sales will be $3.55 billion in 2012. Apple, which launched a new version of its iPad tablet computer on Wednesday, competes aggressively against Amazon's Kindle and Barnes & Noble's Nook e-reader. Barnes & Noble in particular has made a big bet on electronic books. The No. 1 U.S. bookstore chain has relied on digital books and readers to offset shriveling sales at its brick-and-mortar stores. Mark Coker, founder of e-book distributor Smashwords, blamed big publishers for pricing books too high and warned that any Justice Department action that hurts the agency model would benefit Amazon. "I'm incensed over this whole thing," Coker said. "It would be so bad for the future of books if the DOJ does anything to limit the agency model. They are either wittingly or unwittingly acting as Amazon's lapdog." EU probe, Jobs' words The European Commission said in December that it was looking at the same five publishers for potential violations of antitrust law in how e-books were priced. The decision by the European Commission to open an investigation followed raids on the companies in March 2011. Apple's push for agency pricing was detailed in Walter Isaacson's biography of Apple founder Steve Jobs. The book says that Jobs, who died in October, was aware of publishers' frustration with Amazon. It quotes Jobs as saying: "So we told the publishers, 'We'll go to the agency model, where you set the price, and we get our 30 percent and yes, the customer pays a little more but that's what you want anyway.' ... So they went to Amazon and said, 'You're going to sign an agency contract or we're not going to give you the books.' "

@dipesh whenever you add a contact in Android, it ask where you want to store. if you choose phone/SIM and not your gmail, account, then numbers stored on phone/SIM will not be synced ever. It seems that you have stored many contacts on phone, so this is bound to happen. you can however to choose to merge or some option and then try to sync. I had made calender and contacts to be stored on gmail account by default. so no issue of loosing anything, anytime. there is also app for syncing outlook with gmail and also it does USB sync (never tried though). I sync my outlook with gmail and phone with gmail... you can download it from http://www.rimweb.in...015#entry239015

@kshah in India, people always prefer white skin and nobody can doubt about it. the most people buying cars below 5L are just fed up of maruti. Even I own many maruti cars and many times recommend them to friends. but people saw" naah.. maruti, no we want something else". what else, they dont know but no maruti. Tata is good for pick up and HMVs even though their cars value for money.

I installed MS Office, chrome and other required apps gtalk, skype etc. all these apps are not integrated with Metro UI. so whenever you run these, it goes to desktop mode, similar to win7 and look and feel is exactly that of win7, without start button. Even the control panel is the same.So i feel that metro UI is just a "layer" over and above desktop. -
I got an forward from one of my friends about a blog by Kaipullia Vetti on Kingfisher AIrlines. He has throughly analysed the how it has become a major scam in bailout. Vijay Mallya says that he does not want tax payer money. But already he has it in the form of loans and non payment to oil companies. Besides he gave his shares to bank at premium even though the airline was loss making. There are many issues like banks never had personal guarantee from company's director which is against law. Mallya gave guarantee in the year 2010 or so. For this, airline paid him Rs 100 crore (read this). Read the entire blog to understand how systematically he get rid of competition and then also could not make profit.

I agree with Dhiraj. I had tried not 1 but 3 from Tata, 2 Indicas and 1 Indigo. It runs well initial but over a period time, it gives one or the other problem. Mainly, clutch plate, engine noise and shock absorbers. I had sad experience with Hyndai also. But Japenese and European are more reliable. They may be expensive for service but then you get real piece of mind. My qualis had clocked almost 2Lac, never had engine problem, Honda city is currenly 1.15L (now running on CNG), skoda octavia 1.25L, swift 60k.. all these cars running perfectly good and never got problem of shock absorbers and engine. tyres changed, but u cannot do anyhting for that

I think you might have to stretch a little bit at current prices. i got my PC in November for about 23k without any monitor/keyboard,mouse/webcam and no graphic card etc. so you know what i mean, I had opted for AMD processor and Gigabyte Motherboard with USB 3, and HDMI. please provide what kind of game you are looking. currently you say basic, but then your basic games may require better graphic card. so mentioned the games oyu wnat to play and then can people here will able to suggest.

Apple is arrogant from the beginning. I was reading Job biography and he once directed Mac team to remove arrow buttons so that people use mouse. Apple wants to decide how user should, what they should use and not user. I also wonder how apple is able to hang on for iTunes without any competition. There was an app from Real networks but apple forced it closure. nobody is suing apple for its monopoly. why cant we have different software for syncing besides iTunes. Microsoft had to pay for IE. The same logic should apply to apple. Apple is like shaadi ka laddu. khanewala bhi pareshan, naa khanewala bhi pareshan..

they are Champions in marketing and know where and how to hit at target (customers). IMO iPod was the game changer for Apple. they are able to convince people that there is nothing better than apple irrespective of price or what others are offering. people think only apple knows what is the best and they can provide it. others are "idiots". it is more sort of ignorance and also 'cool' factor irrespective of what others provide. Apple is also winning because of "no virus"

^^^ did you try booting into clockwork mod recovery or by pressing 1 and camera button? are you getting charging icon when you charge (just plug in the charger without trying to restart? Remove battery and wait for about a minute or so and then try to boot in CWM or "odin mode".. MIUI ICS ROM now available for Epic. those who are interested can look here.
