Source NEW DELHI, 20 JULY: The government has sought clarification from three private sector telecom operators for not reporting income from selling handsets along with their connections, a Union minister said today. "The Department of Telecommunications (DoT) has sought clarification from Bharti Airtel, Vodafone Essar and Idea Cellular for not showing income from bundling handsets along with connections, for the purpose of calculating revenue share payable to the exchequer," minister of state for communications and IT, Mr Gurudas Kamat told the Lok Sabha. Mr Kamat said the operators have said that they were not selling handsets directly and hence "there is no revenue earned under this head". However, the special audit, ordered by the government last week to check whether leading private telecom players misreported their revenues, will take the issue into account, the minister said. ; IANS

Source NEW DELHI: An unsuccessful attempt at raising the number of its third-generation (3G) service subscribers to one lakh within two months could lead to BSNL following the footsteps of its public sector sibling MTNL and inviting international players to run these next-gen services for 10 years on a revenue-sharing basis. "We are going all out to build our 3G network and operations across the country and grow our subscriber base. But over the next few months, if we don't attract enough subscriber numbers, we may consider a strategy similar to that of MTNL," a senior executive at Bharat Sanchar Nigam (BSNL) said on condition of anonymity. 3G service enables subscribers to access high-speed internet, mobile TV, video conferencing and ultra-fast downloads on their mobile phones. Since private operators are getting ready to launch their 3G services next year following the expected auction of 3G spectrum by December this year, Mahanagar Telephone Nigam (MTNL) and BSNL now want to make the most of their first-mover advantage. Last week, MTNL had invited bids from international firms to run its fledgling 3G mobile services in Delhi and Mumbai for 10 years, in an apparent admission of its failure to generate interest in the service that has managed to attract just 1,000 subscribers in six months of operations in the Capital. To make up for lost time — BSNL could muster only 10,000 3G subscribers in six months — the company has set a stiff target for ramping up the number of 3G customers and would look at foreign participation, if it fails to achieve its goal in the next couple of months, the executive added. The company plans to increase its 3G customer base 10-fold to one lakh subscribers by September, followed by an expansion of 3G coverage from under 100 cities to 1,000 cities by year-end. It plans to launch services such as video-on-demand and games-on-demand as well as offer an extensive music library for downloads in the next three months. Late last year, both MTNL and BSNL were given 3G spectrum — the airwaves on which these high-end services can be offered — on the condition that both the operators will match the highest bid offered by private telcos during the auctions. If BSNL invites bids for running its 3G operations, this could be a shot in the arm for several telecom players waiting to enter the Indian market, the fastest-growing market in the world. The company's state-of-the-art 3G network may also attract some of the best mobile virtual network operators (MVNO). BSNL offers both landline and mobile services in 20 of the 22 telecom circles, and has a mobile customer base of 50 million.

BSNL launches new service delivery platform for 3G customers Source Bharat Sanchar Nigam Limited (BSNL) today launched its new service delivery platform 'BSNL Live' - a web portal that would offer videos on demand and movie streaming for its 3G customers for the first time in the country. "The portal has movie streaming, games, full track songs, video clips and it will be a single window shop for all the mobile value added contents," BSNL CMD Kuldeep Goyal told reporters here today. He further said the technical platform hosting 'BSNL Live' was a Service Delivery Platform (SDP) which, as a mobile operator, BSNL was the first to deploy. It was built to meet the needs of mobile network operators, media companies, service providers etc. It has been developed with the assistance of Ericsson, he further said. This service which was launched today would now be available in over 100 cities of northern and eastern parts of India including Punjab, Jammu and Kashmir, Himachal Pradesh, UP, Uttrakhand, Bihar, Jharkhand, West Bengal, Orissa, Andaman and Nicobar. "After this 760 more cities countrywide are planned to be covered progressively in the next 6 months," he said. The launching ceremony also saw the movie premier of 'Jail' on BSNL 3G mobile through BSNL Live portal in the presence of film Director Madhur Bhandarkar, Actor Neil Nitin Mukesh, and actress Mughdha Godse. The end user price points of the contents like games will be Rs 35-100, songs Rs 15, video Rs 10 to Rs 20, video on demand at Rs 40 and wallpapers at Rs 10. Moreover, the video category will have contents like an exclusive preview of forthcoming films, footage of celebrities, interviews etc. However, Goyal said BSNL has been able to rope in just 13,000 3G mobile customers since its launch. "We have found that several areas were not fully covered under 3G services and we are now improving the coverage," he said, adding, "the company is focusing more on value added services which will help attract more customers to 3G mobile," Goyal said. At present, Value Added Services constitute 5-6 per cent of the total revenue of BSNL, he said.

Unitech Wireless gets NLD, ILD licences Source NEW DELHI: Unitech Wireless, a part of the realty major Unitech Group with a pan-India mobile licence, has got both National and International Long Distance Licences. A Department of Telecom official said the company has got NLD, ILD licences. The company is planning to start the GSM-based mobile service in the last quarter of the current calendar, a Unitech official said. With NLD and ILD licences the company will be able to provide cost-effective STD and ISD services to its customers from day one of the launch. The new licences will help the company save on traffic carriage expenses as it will be carrying its own traffic in NLD and ILD segments. All the big telecom players have their own NLD, ILD licences. Meanwhile, the Government has deferred its decision on a proposal to increase Unitech Ltd's foreign shareholding in Norway telco Telenor to up to 74 per cent. Telenor had agreed to buy about 67 per cent of Unitech Wireless but the transaction needs government approval. Foreign Investment Promotion Board is learnt to have held up the proposal over Home Ministry's concerns over security issues. As Telenor has a presence in both Pakistan and Bangladesh the board had asked for more time to study the proposal. However, the Department of Telecom has give a no objection certificate to the proposal. Unitech Wireless has licences to provide telecom services in all of the country's 22 telecom circles, but is yet to start operations. Telenor bought a 67.25 per cent majority stake from Delhi-based real estate group Unitech in two tranches. It has already completed acquisition of 49 per cent in the company.

  20. Source TORONTO: Blackberry maker Research In Motion Ltd (RIM) will pay $267.5 million to California-based Visto Corp to settle a patent infringement lawsuit. Visto, which is a wireless e-mail company, had slapped the lawsuit on RIM in a Texas court for patent infringements in 2006. In its lawsuit, the US company had said that RIM was using its technology without authorisation. Visto's software is used Vodafone, Deutsche Telekom AG's T-Mobile and Sprint Nextel Corp. But RIM hit back, saying that Visto's patents involved no new inventions. It also filed its counterclaim, leading to a war of lawsuits between the two companies in the US, Canada and Europe. But RIM and Visto reached an agreement Thursday, with the BlackBerry maker agreeing to pay $267.5 million to settle the case and use Visto's patents in the future. "The key terms of the settlement involve RIM receiving a perpetual and fully-paid license on all Visto patents, a transfer of certain Visto intellectual property, a one-time payment by RIM of US $ 267.5 million and the parties executing full and final releases in respect of all outstanding worldwide litigation,'' said a statement by the BlackBerry maker here. The global wireless giant said the settlement will be completed by July 20, 2009. This is the second time in three years that RIM has to pay a huge amount to settle a patent dispute with another company. In 2006, the Waterloo-based Canadian giant had paid a whopping $612.5 million to settle a patent dispute with NTP Inc., a Virginia-based patent-holding company. It had filed the lawsuit against RIM in 2001, claiming that the BlackBerry maker used its patents without authorization to create the push e-mail platform on its smart phones. After a five-year legal battle, RIM paid $612.5 million to the American company "in full and final settlement of all claims against RIM, as well as for a perpetual, fully-paid up license going forward.''

Legal | Madras HC sets aside IPAB order on dual SIM Source Earlier this week, IPAB had, on an appeal filed by mobile phone importer Spice Mobile Ltd, passed an interim order on staying operation of patent No. 214388 Mumbai: The Madras high court on Friday set aside a Monday order by India’s Intellectual Property Appellate Board (IPAB) that suspended a patent for dual SIM (subscriber identity module) mobile phones granted to S. Ramkumar, a Madurai- based electronics engineer. The patent was granted in 2008 by the Chennai patent office. Earlier this week, IPAB had, on an appeal filed by mobile phone importer Spice Mobile Ltd, passed an interim order on staying operation of patent No. 214388. On the basis of his patent, Ramkumar had sought seizure of imports and local production of multiple SIM card mobile phones by companies such as Samsung India Electronics Ltd, Spice Mobile, and LG Electronics India Ltd, among others. Ramkumar’s lawyer K.M. Aasim Shehzad told Mint the Madras HC passed the order.
  23. Source NEW DELHI: The government, in an unprecedented move, has withdrawn its approval to Swiss-registered firm ByCell to launch telecom services in India on the ground of security concerns. Promoted by Russian businessmen, ByCell holds 74% stake in an Indian telecom company, Hyderabad-based Jayalakshmi Group. The joint venture between the two group was announced in 2006. ByCell had got approval to operate in 13 circles including Assam, Bihar, north-eastern states, Orissa and West Bengal, but the Department of Telecom (DoT) had withheld its licence because of the security reason. In 2006, it had received FIPB approval to invest Rs 500 crore. In fact, FIPB had given By-Cell approval twice to invest in India, but the DoT refused to give it licence on the ground of security threat. A senior government official said that the home ministry had expressed security reasons on the basis of the antecedents of ByCell's main promoters. The government is also not happy about the ByCell's shareholding structure and its source of funding, a source said. In 2006, ByCell secured FIPB approval to launch mobile services in five circles. The company, in fact, got a letter of intent for launching its services in Assam, Bihar, Northeastern states, orissa and West Bengal. But, the government refused to issue licence to operate in those circles. In 2008, the company moved to court to obtain licence to operate in the country as it had paid the licence fees and other charges to the government. On the direction of the court, it received licence from DOT to start its services in India. Meanwhile, it also received clearances from the home ministry. On the basis of this, the company decided to invest $500 million. But again, the home ministry received certain information against the company, which forced it to ask FIPB to revoke all the clearances granted to it so far. Besides revoking all the investments permission granted to ByCell, FIPB on Friday deferred Unitech Wireless's proposal to hike the foreign stake in the firm up to 74%. Norway-based Telenor is the foreign partner in Unitech Wireless. As security concerns have been expressed on Telenor as it has operations in Pakistan and other countries, the government is not comfortable in allowing its stake in the company from the existing 49% to 74%. The board, however, cleared 16 foriegn direct investment proposals worth Rs 892 crore, most of which will be for a hydro power project in Sikkim. On the recommendations of the FIPB, the government also deferred 13 proposals, including that of Vijay Mallya-promoted United Breweries request to raise Rs 708 crore through convertible warrants. Among cleared proposals, Teesta Urja will bring in Rs 547.20 crore for developing 1,200-MW hydro power project in Sikkim. The government also allowed IL&FS Trust Company to hold two per cent stake in Multi Commodity Exchange of India, that will bring in Rs 108 crore of FDI.

The much-talked about Google Android phone is likely to hit the Indian market by July-end, with top handset makers HTC, Motorola and Samsung firming up plans to ship the device to the country. It has been learnt that Samsung is planning to ship the Google Android phone by July, as part of its global launch. Last week, Andy Rubin, senior director for Mobile Platforms for Google had said that around 18 phones based on the Android operating system would be available in the market worldwide by the year-end. With the launch of the system, the G-phone will compete against other mobile operating systems such as Microsoft Windows mobile, RIM’s BlackBerry platform, Apple’s proprietary iPhone and Symbian, on Nokia handsets. Three mobile manufacturers HTC, Motorola and Samsung are planning to bring in the device to the Indian market. A person close to the development said that the first Android phone G1 from HTC witnessed positive responses from the US market after it was launched late last year. “India is a growth market and mobile manufacturers are launching their latest product lines, and Android will not be left behind. The first phone will hit the market in July. Motorola is planning to launch it in November,” he said. Ajay Sharma, country head, HTC India, told Financial Chronicle that the company was shipping the new HTC Magic G2 phone for the UK market. However, he declined to share any dates on the India launch. “Every Android device requires clearance from Google, since it is based on the Android operating system. We cannot share any exact date for the launch of the Android phone in the Indian market, but it is likely to be launched by the end of this year. Globally, we have two handset models G1 with T Mobile and the recently launched Magic G2,” Sharma said. The Motorola spokesperson said, “We will be shipping Android products this year and are excited about the upcoming portfolio. However, we are not making any announcements on Android-based products at this time.” Handset manufacturers ASUS, Huawei, Sony Ericsson, Motorola, Samsung and HTC have partnered together under the open handset alliance to bring in devices on the Android platform.

Mobile cos line up Google's Android phone launches Source KOLKATA: Google's smartphone operating system (OS) Android is soon going to get a leg up in India with leading cellphone vendors such as HTC, Samsung, LG and Motorola firming up plans to roll out a portfolio of such handsets. The vendors plan to target Android phones for urban youth users and position them in the mid to high-end segment. While HTC has just started shipping the first Android phone to India, Samsung will roll out its first device, christened Galaxy, next month. Android phones from LG and Motorola's stable are also likely to hit the market by December, industry sources said. Google too expects faster adoption of the Android platform in India with such launches at varying price-points. Talking to ET, Google India director (products) Vinay Goel said 47 companies are working on the Android platform. "Globally, around 15-20 Android handsets will be launched by December. We expect some of these models will be shipped to India as well," he said. HTC has already received favourable response in India from its first Android handset. "Android is an evolving platform and will be one of the mainstay for HTC. It drives internet mobility and the touch factor adds novelty. Since, we roll out 2-3 devices in India every quarter, some of them will be on this platform," HTC India country head Ajay Sharma said. Samsung Mobile country head Sunil Dutt said the company will launch a portfolio of touchscreen Android handsets by year-end. "We will work with Google to ensure faster adoption of the devices in India. Android has the potential to emerge as the next big mobile phone OS," he said. Vendors like Samsung, HTC and LG are bullish that Android will be able to compete against the two most popular smartphone OSSymbian and Windows Mobile. "Our research has shown that consumers really don't care about their handset OS. All they want are exciting applications and experience which are the main driving factors behind Android," said Mr Goel. LG India's head (GSM mobile ) Anil Arora feels the rest test for Android will begin next year when the population of such devices reach a critical mass. "The fact that Android allows much more flexibility to consumers for customising the look and feel of their handset could be a growth trigger," he said. Google believes vendors need to launch some handsets in the Rs 10,000-15 ,000 price range to target the mainstream Indian market and ensure Android's success. "Android being open source, there is no license fee which can bring down handset prices," Mr Goel said. As of now, HTC's first Android phone is sold in India at around Rs 30,000 and Samsung plans to launch Galaxy at Rs 29,000.
