NEW DELHI: Tata Teleservices, which is running its telecom services under the brand name Tata Indicom has emerged out as the winner in terms of network availability for the period Jan-March 2008. Tata Teleservices Ltd(TTSL), the second largest CDMA operator in the country has said in a statement that it has the least congestion on its network in terms of point of interconnection (POI). POI reflects the ease with which a customer on one network is able to communicate with a customer of another network and it also reflects the effective interconnection between two concerned networks. The benchmark that has been notified by the sector regulator is less then 0.5 per cent. It means out of 200 inter-network calls only one call should face congestion problem. The company has made this statement on the basis of a latest report by the Telecom regulatory Authority of India (TRAI). The report on network congestion stated that TTSL has recorded the least congested POI of only ten as compared to 83 POI of Airtel, 41 of Reliance and 43 of Vodafone for the month of March, 2008. Also, TTSL is the only operator whose POI congestion has consistently reduced over a period of three months, the statement added. "Today mobile customers are very discerning and they look for quality of service than just cost advantage. From crystal clear voice quality and minimal call drops our customers experience the advantages of being on Tata Indicom's network. This acknowledgment further reassures our customers and endorsers that we provide nothing except the best," said TTSL Chief Technology Officer A G Rao. what wa sthat of BSNL . . .
  6. RIL drags RCOM to arbitration on MTN NEW DELHI: The plot has thickened. Mukesh Ambani-owned Reliance Industries (RIL) on Thursday said it has started arbitration proceedings against younger brother Anil Ambani’s Reliance Communications (RCOM) to thwart the latter’s merger with Africa’s largest telco MTN. Sources in RCOM dismissed RIL’s move and said the arbitration can only happen when ‘both’ parties refer the dispute to a person outside the court. According to RCOM, there was no scope for arbitration as there was neither any dispute nor any occasion for any conciliation process. It would appear that Samajwadi Party leader Amar Singh’s attempt to invoke political intervention at the highest levels of the government to settle the dispute between the Ambani brothers has come a cropper. Thursday’s development comes three days after the RIL chairman Mukesh Ambani met Prime Minister Manmohan Singh. While it was widely speculated that Mr Singh could play peacemaker between the feuding brothers, the Prime Minister’s office on Tuesday dismissed suggestions that the PM would do any such thing. Mr Amar Singh, whose party’s support is crucial for the survival of the UPA government, had slammed RIL’s move to thwart an RCOM-MTN merger and demanded that the Prime Minister intervene to solve the feud between the Ambanis. “The MTN deal is good for the country,” he had said. RIL’s move could potentially derail the ongoing talks between RCOM and MTN. Besides, the latest spat between the two brothers comes barely a week after MTN and Reliance Communications extended their 45-day exclusivity talks by 15 days. The extended exclusivity period, during which only RCOM gets to negotiate with the South African Telco, expires on July 21. Meanwhile, in another development, RIL sent yet another communication to MTN, stating it would take legal auction if the South African telco was to merge with RCOM. This is RIL’s fourth letter to MTN on this issue. Industry sources say MTN has asked RCOM to sort out all legal issues with RIL as a precondition for the deal. There is a buzz that MTN had extended the exclusivity period by 10 days for the two groups to sort out their differences. At the same time, as reported by ET earlier this week, MTN is learnt to have sent feelers to Bharti Airtel for reviving talks if it failed to clinch a deal with RCOM. MTN and Bharti Airtel were close to a merger in May but the Indian telco called off the talks after the two companies failed to agree on the corporate structure of the combined entity. RIL said it had started arbitration process since RCOM had failed to participate in meetings or enter into talks to resolve a dispute concerning ownership of shares. The dispute relates to the RIL stance that it has the right of first refusal over RCOM in the event of a change of management, a claim that has been repeatedly denied by Anil Ambani’s Reliance-ADAG. “RIL has commenced arbitration proceedings by nominating Justice BP Jeevan Reddy, a former judge of the Supreme Court of India, as an arbitrator. RCOM has refused to participate in the conciliation meetings under the alternate dispute resolution provisions contained in the Non-Competition Agreement,” RIL said in a statement. The war of words continued as the RCOM spokesperson immediately retaliated stating that ‘RIL’s notice for arbitration proceedings is legally and factually unwarranted’. “RIL’s malafide design to derail MTN discussions is clearly exposed. RIL has successfully destroyed India’s image in foreign eyes,” the RCOM spokesperson added. Again, responding to RIL’s allegations that RCOM had refused to participate in the conciliation meetings, the telco said “neither was any dispute nor any occasion for any conciliation” process. Another RCOM source pointed out that even if RIL’s claims were ‘theoretically true’, RIL could only start arbitration in the event of a deal. “RIL claims that it has RoFR if there is a transfer of shares or a change in management. Neither of this has taken place. So, where is the case to launch an arbitration,” the RCOM source added. A merger between RCOM and the South African telco will create a global telecom giant with close to 120 million subscribers with its footprint across 23 countries and covering a population of two billion, a third of the world. The combined entity will have a market cap of over $60 billion, revenues of $14.4 billion, an operating profit of over $6 billion and assets worth $26.8 billion, and emerge as the second-most profitable operator in emerging markets after China Mobile.

Majority of the websites that sell ringtones or mobile phones are conning children and teenagers by providing unclear information about the charges of their services, says a new probe by the European commission. Over 90 per cent of websites make use of various tactics to lure users that include signing up for subscriptions when they seem to download one-off tunes and free offers to enrol them for long-term paid contracts, the study found. In order to curb such exploitation of young mobile phone users, Brussels is all set to launch inquiries into dozens of British ringtone websites and many others across Europe. "Some children as young as five have a phone and young people often see ringtones as a fashion statement. Children are particularly vulnerable consumers and our initial investigation into the mobile services market shows a high number of rogue traders ready to cash in on this," Times Online quoted Meglena Kuneva, commissioner for consumer protection, as saying. The probe has highlighted misleading practices common to the 550million pounds European ringtones market. What happens usually is that a large number of consumers believe they are buying a single ringtone, but in reality they are being charged to a 1.50 pounds tune every day or for a weekly subscription. They also discovered that the word "free" might be a tricky aspect as it can be used to offer an unpaid tune while luring consumers into longer-term paid contracts. These results of EU investigation will now be used by national regulators to force many changes in the industry.

DoT dilutes pricing for excess spectrum; may cause huge losses NEW DELHI: The Department of Telecom has diluted the proposed pricing of excess spectrum held beyond the contracted limit by mobile operators, which may cause a loss of over Rs 5,000 crore every year to the government. According to highly placed sources, the DoT had originally planned to impose annual fixed charges ranging between Rs 15 crore to Rs 290 crore (depending upon the area and amount of spectrum) and also increase the fee as percentage of gross revenues of a mobile operator. While the revised plan envisages only a marginal increase in the annual fee as percentage of gross revenue by one per cent for spectrum (radio frequency) beyond 6.2 MHz and two per cent for eight MHz and above. This would fetch the government only Rs 1,250 crore, compared to over Rs 6,000 crore as per the original plan, sources said. As per the original plan, the DoT had proposed annual charge of Rs 290 crore for 12 MHz of spectrum in metros and also double the fee to 10 per cent of gross revenue from existing level of five per cent. The Telecom Commission is scheduled to meet on July 18 to consider the proposal and if implemented, this will not only legalise the excess spectrum held by various mobile operators, but would also leave no scope for new operators to expand their operations due to paucity of scarce resource. Some of the new operators, when contacted, voiced their opposition to the proposed scheme saying this was in sharp contrast to Prime Minister Manmohan Singh's suggestion during India Telecom Summit 2007 that revenue potential of the spectrum for the government must not be lost sight of. Communication and IT Minister A Raja also met Singh and Finance Minister P Chidambaram earlier this month and discussed the revised proposal and the same has been sent to the Telecom Commission for its approval. Sources also said that revised pricing would be implemented both for GSM and CDMA based mobile operators having spectrum beyond 6.2 MHz in case of GSM and the equivalent amount of spectrum held by the CDMA service providers. The new operators, who are yet to start services and have been allotted start-up 4.4 MHz of spectrum, are of the view that the DoT had earlier also succumbed to the pressures of existing mobile operators as it withdrew the report of Telecom Engineering Centre (TEC) suggesting tough subscriber linked norms for allotment of additional spectrum beyond 6.2 MHz. Sources said that a Memorandum for Telecom Commission has been prepared based on the revised pricing regime and the same has also been distributed among various members and would be taken up for approval on July 18.

MUMBAI: Public sector Bharat Sanchar Nigam (BSNL) is in talks with Tata Teleservices (TTSL), Reliance Communications and Aircel for sharing passive infrastructure as it attempts to expand coverage in the shortest possible time. “Discussions are at a preliminary stage. We are talking to operators who have not yet formed an alliance for tower sharing,” a BSNL official told ET. Bharti Airtel, Vodafone Essar and Idea have already joined hands to form Indus Towers, which has 70,000 towers across India and is the world’s largest tower firm. Aircel’s GSM expansion to 14 circles gives BSNL an opportunity to have the company as a tenant on its telecom towers while the PSU firm can be a tenant on the towers of TTSL and RCom and vice versa. However, he ruled out the formation of a tower company on the lines of Indus Towers, saying it will not be feasible. Many of BSNL’s towers, however, can’t be shared and have been designed for only one operator. The capex required for a GBT is higher than that for a roof-based tower. However, a GBT can accommodate higher number of tenants 3 to 5 while an RTT can accommodate only 2 at most. This will be the first time that BSNL will share its infrastructure with private operators. BSNL’s policy, till now, has been to stay aloof from all alliances in the telecom space.
