Kanimozhi, Sharad Kumar to remain in jail as Delhi high court rejects bail pleas Source DMK MP Kanimozhi and Kalaignar TV MD Sharad Kumar will remain confined to Tihar Jail as the Delhi high court today dismissed their bail pleas in the 2G case, saying they have strong political connections and the possibility of them influencing witnesses cannot be ruled out. "They have got strong political connections. Kanimozhi belongs to the same political party to which accused A Raja belongs and it is sharing power in the Central government. "Thus, considering their financial and political clout, a possibility cannot be ruled out that if they are freed at this stage, they would interfere with investigation or try to influence the witnesses. Thus, at this stage, I do not deem it appropriate to admit the petitioners on bail," Justice Ajit Bharihoke said in his 37-page order. The 43-year-old daughter of DMK supremo M Karunanidhi and Sharad Kumar, named as accused in the second charge sheet for allegedly taking bribe of Rs200 crore, were arrested on May 20 after the special court dismissed their bail pleas in the case. The court noted the CBI allegations that Kanimozhi and Sharad Kumar received illegal gratifications in the DMK-run TV channel from co-accused and Swan Telecom promoters, Shahid Usman Balwa and Vinod Goenka, from the account of DB Realty group companies as "reward for undue favours" shown by former telecom minister A Raja in allocation of 2G licences. "Kanimozhi and Sharad accepted and received an illegal gratification of Rs200 crores in Kalaignar TV from the co-accused Shahid Balwa and Vinod Goenka in the year 2008-09 as a reward for undue favours shown by accused A Raja in connivance of other public servants to Swan Telecom in the matter of allocation of valuable scarce spectrum," it said.

Supreme Court Issues Notice To Centre on Ramdev's Eviction Source NEW DELHI: Taking suo motu cognisance of forceful eviction of yoga guru Baba Ramdev and his followers from the Ramlila grounds here, the Supreme Court on Monday sought the Centre's response on the incident. A vacation bench of justices B S Chauhan and Swatenter Kumar issued notices to the Union home secretary, chief secretary of Delhi, Delhi administration, and Delhi police commissioner asking them to respond within two weeks. The court asked them to reply as to what were the circumstances under which the people had to be dispersed at midnight by the use of force. The court posted the matter for hearing in the second week of July. However, the court declined to entertain a petition filed by advocate Ajay Aggarwal on the issue. The bench expressed its displeasure that before the matter came up for hearing before it, the entire contents of the petition were leaked to the media. Police had cracked down on Baba Ramdev and thousands of his supporters at Ramlila Maidan on Saturday night, forcibly ending their hunger strike on corruption and black money issues.

Right to Privacy May Become Fundamental Right in India By amending Indian Constitution.. Expected To Be Tabled in Monsoon Session of Parliament.. Source NEW DELHI: The law ministry is working on a proposal to make right to privacy a fundamental right in the Indian Constitution. Corporate lobbyist Niira Radia's phone tapping row and new-age surveillance techniques being extensively used to crack down on economic offences are the trigger behind the move. "We are working on making right to privacy a fundamental right. It is likely to be tabled in the monsoon session of Parliament. However, it's difficult to commit the timeframe," law minister Veerappa Moily said. The right to privacy would include the right to confidentiality of communication, confidentiality of private or family life, protection of his honour and good name, protection from search, detention or exposure of lawful communication between individuals, privacy from surveillance, confidentiality of banking, financial, medical and legal information, protection from identity theft of various kinds, protection of use of a person's photographs, fingerprints, DNA samples and other samples taken at police stations and other places and protection of data relating to individual. "Many of these are already observed at a practical level. For example, it's a part of professional ethics of a lawyer or a doctor not to reveal details about clients or patients. The same applies for the banking sector. Apart from strengthening norms for interception of communication, the proposed Act will guarantee an individual's right to privacy. It's similar in the way the Constitution guarantees existing fundamental rights like right to equality, right to freedom of expression etc," explained a senior law ministry official. The fundamental rights guaranteed by the Constitution include right to equality, right to freedom of speech and expression, right to property, right to education, right to conserving own culture, language and script, right to religion and right against exploitation. If the legislation is passed, it would address several concerns expressed by some sections of the civil society. For instance, there has been outrage over the `compromise' of an individual's privacy in a project like UID, where all personal data will be available at the click of a mouse.
