  4. Initial MNP Data Reveals Vodafone As A Clear Winner Followed By Idea After a long wait, Finally India will see nation wide introduction of Mobile Number Portability (MNP) — which allows a mobile phone users to change the service provider while retaining existing mobile number, which was launched pan-India on January 20. Now the Initial data from the first 15 days of Pan India MNP stats are with us ! The initial number shows India’s 2nd largest Mobile Service provider Vodafone leads followed by IDEA Cellular as per official MNP data available with us. Vodafone has gained by a total of 94747 GSM subscribers which is the highest number of new mobile subscribers additions via MNP however the operator lost 44,041 subscribers. While IDEA Cellular notched up 74978 new subscribers at the end of Janurary-2011, While market leader and largest GSM operator Bharti Airtel added up 77240 Port In subscribers from other operators. It looks like ad campaign by Vodafone (EveryBody”s Welcome ) and Idea (No IDEA GET IDEA) has really helped both operators “Where to Switch?” and gained a good momentum of subscribers. State run Bharat Sanhar Nigam Ltd and CDMA Major Tata Teleservice (Tata Indicom) and Reliance Communication emerge as the biggest looser in the MNP scenario. These data are as of Jan 30th so everyday there is ups and downs happening in the industry . 8. 2G scam: CBI grills Raja for the fourth time The Economic Times l 2 Feb l New Delhi Former telecom minister A Raja is being grilled by the CBI for the fourth time in connection with the 2G spectrum scam. Raja reached CBI headquarters early on Wednesday morning for another round of questioning by the investigative agency. CBI sleuths had questioned Raja for the third time on Monday. According to sources, CBI asked him about the role of some of his kin in a few offshoot companies of some telecom firms besides the flow of funds. Following this on Tuesday, the CBI had quizzed Raja's brother and a close associate. Official sources said Raja's brother - A Kaliya Perumal was questioned for over seven hours at the agency's headquarters. They said a close associate of Raja was also questioned. Sources said the agency is in the process of questioning everyone whose premises were searched by it in connection with its ongoing probe into the scam. Though officials were tight-lipped about the line of questioning, sources said, Perumal was questioned on certain financial transactions and his dealings with certain firms. Raja was forced to resign on November 14 last year in the wake of the CAG report which held that the spectrum allocation at undervalued prices resulted in a notional loss of Rs 1.76 lakh crore to the state exchequer. Raja got the telecom portfolio on May 18, 2007 and was re-elected as a member of the 15th Lok Sabha and continued as telecom minister from May 31, 2009, till November 14, 2010 before he tendered his resignation. The Supreme Court has asked CBI and Enforcement Directorate to submit status reports on their investigations into the 2G spectrum case to it by February 10 when the case will come up for further hearing. In its FIR, CBI mentioned the loss as Rs 22,000 crore based on CVC findings which had referred the case to it.

  11. Leakage of Tata-Radia tapped talks being probed: Govt tells SC The Economic Times l 1st Feb l New Delhi Government today told the Supreme Court that it was taking seriously the issue of leakage of conversation between Tata chief Ratan Tata and corporate lobbyist Niira Radia and that an inquiry has been ordered into it. "The government views the disclosure of such information seriously and in this context, an inquiry has been ordered," an affidavit filed by the government said. It also denied the allegation of Tata that it had adopted a lackadaisical attitude on a petition filed by Tata. "I deny that the government has adopted a lackadaisical attitude or that it was standing by and allowing leaked material of this kind to be freely distributed and published," the two-page affidavit filed by Additional Director of Income Tax (Investigations) said. The affidavit said that by an office memorandum issued on December 27, 2010, the Ministry of Finance appointed two senior officers to inquire into the leakage of "classified documents/telephonic intercepts". "The terms of reference of the inquiry committee are detailed and comprehensive and reflect the concern of the Ministry of Finance to properly investigate the matter and to take a comprehensive view of the subject," it said. The government said it is not correct on the part of Tata to allege that it is its perception that the leakage of such material and its consequential publication were not a matter of concern. "It is not suggested by the government that it is under no duty to ensure that the wire tapped material is not leaked," the affidavit said. Tata had moved the apex court seeking a probe into the leakage of the tapes of his private conversation with Radia. In his petition, he had sought action against those involved in the leakage, alleging that such an act amounts to infringement of his fundamental right to life, which includes right to privacy under Article 21 of the Constitution. Tata had argued that making public his conversation with Radia also violates his Right to Speech and Expression under Article 19(1)(a) of the Constitution. Tata's petition, filed on November 29 last, had also sought that as an interim relief steps should be taken to prevent online portals and electronic media from publishing material which had been "illegally" and "unlawfully" obtained by them. Tata had also sought the court's direction to the government to "retrieve" and "recover" the leaked tapes. In response to Tata's petition, the government in its affidavit filed earlier in December last year, had told the court that it was not possible for it to stop the publication of transcripts of leaked tapes or to retrieve them. The government had also contended that the income tax department cannot take action against any cell phone service provider who may have been responsible for "unauthorised supply of information". "It is not possible or practical for the government to take steps to retrieve the various copies of some of the transcripts which have appeared in the print media or in the electronic media and which are being circulated on the Internet," the government affidavit had said. In response, Tata, in his counter-affidavit early last month had accused the government of adopting a "lackadaisical attitude" on the leakage of his tapped telephonic talks with Radia, saying the government has remained least bothered about the violation of his individual's privacy. "Petitioner (Tata) is seriously concerned about the lackadaisical attitude of the government on standing by and allowing purloined material of this kind to be freely distributed and published without taking any step to retrieve it or to find out the source of leakage," Tata had said in his affidavit. He said failure to protect his tapped conversations from being leaked and letting it reach outsiders "was not a matter of many great moments in law". Tata had pointed out that the Centre's affidavit to the apex court "gives the impression that it is the perception of the government that while protecting such wiretap material is required by the rules, the failure to safeguard such material leaking out and reaching the hands of outsiders does not warrant any step on the part of the government to retrieve it" or to probe as to how the leak occurred.
  12. 2G spectrum: Trai may recommend a one time fee The Economic Times l 1st Feb l New Delhi Telecoms regulator Trai may recommend a one time fee ranging from Rs 50.98 crore to a maximum of Rs 707.28 crore for every unit of second generation (2G) airwaves that incumbent GSM-based mobile phone companies have beyond the 6.4 MHz limit. The regulator may recommend that 2G airwaves in Uttar Pradesh (East) be priced the highest at Rs 707.28 crore as this region holds the maximum potential for future growth, while spectrum in Jammu and Kashmir be charged the least, according to a draft report, reviewed by ET (refer table). Calculations by ET reveal that if an operator were to have one unit of airwaves beyond the 6.2 MHz mark across the country, it must shell out Rs 8380.55 crore, as per the Trai draft report. The move will impact Airtel, Vodafone Essar, Idea Cellular, Loop (in Mumbai), Reliance Communications, and state-run telcos BSNL and MTNL. The government may also apply this one time fee for additional airwaves allocation for new entrants and dual tech companies. Currently, these companies have been given only 4.4 MHz of startup GSM airwaves in most circles. If Trai’s draft pricing formula were to be considered, telcos such as Tatas and RCOM may have to pay about Rs 15,000 crore each for pan-India airwaves to take their total holdings to the 6.2 MHz. These companies have been vigorously arguing that that mobile permits entitle them to a minimum of 6.2 MHz of spectrum and only allocations beyond this amount can be linked to a market linked pricing mechanism. Last week, telecoms minister Kapil Sibal had said that the country will charge mobile operators for additional spectrum at market-determined prices as specified by Trai. Sibal was appointed in November to clean up the sector and bring about reforms after former telecoms minister A Raja resigned facing allegations of selling airwaves for cheap, causing a loss of Rs 1.76 lakh crore to the exchequer according to the national auditor. Last year, Trai had proposed that GSM telecom companies pay for 2G airwaves beyond the 6.2 MHz limit in every region at rates discovered during the third-generation spectrum auctions. However, due to stiff opposition from the GSM service providers, the regulator said it would revisit the issue. Under the new pricing methodology, since incumbent GSM operators largely have airwaves beyond the 6.2 MHz mark in the metros and category A circles, their outgo is set to be lower. This is because the regulator is of the view that incremental 2G spectrum is less valuable in the metros, more valuable in category A regions and most valuable in category B areas. In parts of the country that are designated as Category C regions, the regulator in its draft report said that the incremental 2G spectrum beyond the 6.2 MHz would be about 2.4 times the cost of 3G airwaves. While a mobile permit allows a maximum of 6.2 MHz of airwaves per circle, GSM operators cite subsequent policy changes that entitle them up to 15 MHz or units of airwaves in each region, and add that the legality of this policy change has been upheld multiple times by the governments and the courts. This is hotly disputed by CDMA-based and dual technology companies such as Reliance Communications and Tata Teleservices who content that a mobile permit entitles an operator a maximum of 6.2 MHz of airwaves per region. India’s national auditor, in its report, submitted in Parliament in November 2010, said loss to the exchequer due to allocation of airwaves beyond the contracted amount to nine GSM players – Aircel, Bharti, BPL (Mumbai), BSNL, Idea, MTNL, Reliance, Spice (Punjab) and Vodafone is Rs 2,561 crore, ‘based on the amount charged from CDMA operators for grant of GSM spectrum in 2007’. The Comptroller and Auditor General of India in its report also added that going by Trai’s proposals, the loss to the exchequer was Rs 36,993 crore. Circle Price per MHz of additional 2G spectrum Delhi : 376.82 Mumbai 239.83 Kol 96.15 Maharashtra 581.03 Gujarat 526.29 AP 609.54 Karnataka 494.98 TN 591.97 Kerala 458.17 Punjab 364 Haryana 264.25 UP(West) 587.32 UP(East) 707.28 Rajastan 617.09 MP 591.41 WB 513.78 HP 62.64 Bihar 342.34 Orissa 163.18 Assam 69.79 NE 71.71 J&K 50.98

  16. Vodafone mulls new pact with Essar The Economic Times l 31 Jan l Mumbai Global telecom giant Vodafone may push for a new agreement, including crucial changes in shareholder rights with its Indian partner Essar, if the latter decides to only part sell its stake in the joint venture Vodafone Essar. Essar has a "put option" to sell its entire 33% stake for $5 billion, or to sell a part of it at a discovered price, to Vodafone which can be exercised by May. The current agreement gives the Ruias of Essar the same boardroom rights, including a veto power, as long as they hold a minimum 10% stake in the JV, Vodafone Essar. Sources said Vodafone wants a new agreement in which Essar's rights could be diluted, irrespective of how much stake the latter continues to hold. Vodafone's Italian CEO Vittorio Colao wants more flexibility in dealing with the local partner given their troubled history. This could be a crucial bargaining chip, or counter pressure, as both the shareholders are in the midst of an ugly spat over potential valuation of Essar's 33% shareholding in the JV. Under the current scenario, Essar with four board members has veto powers on any Vodafone plan involving expenditure over $50 million and right of first refusal over its partner's stake, which is mutual. While Vodafone would prefer to buy the entire Essar stake later this year, its local partner is most likely to opt for a part sale keeping its shareholding well above the requisite level to keep its rights. A put option gives the seller rights to offer shares at a specified price but does not place any obligation on the party to sell within a specific time. A source in the Essar group, without wanting to be named, said it was very clear that the 10% stake will be retained to keep the rights intact. When contacted, a Vodafone spokesperson in London said that the company does not divulge shareholder rights and therefore, declined to comment. Essar is expected to oppose any move to renegotiate the existing agreement unless both players agree to an amicable settlement. Sources said Vodafone believes the terms of its four year-old JV must be renegotiated-if Essar wants to extend the association-as the Indian partner holds significant boardroom leverage right now. It does not want to be frustrated by the local partner who would wield the same powers even after unlocking significant value in a part stake sale. This could be another flash point depending on how the current situation unfolds. Essar's relationship has not been the same with Vodafone after its former CEO, India-born Arun Sarin, left the company over two years ago. It was under Sarin that Vodafone acquired 67% stake in Hutchison Whampoa , where Ruias hold the remaining 33%, for $11 billion in 2007. The latest row between the partners erupted when Essar embarked on the reverse merger of Essar Telecom Holdings (ETHL) into its listed group firm, India Securities. Essar started the process as a price discovery move with the put option date approaching. ETHL holds a part (11%) of the Essar stake in the JV. Vodafone said it was concerned that such a move could distort the valuation of the JV and that the value of India Securities could be misinterpreted as a fair market value of Vodafone Essar. Vodafone has filed an appeal against Essar's move in the Madras High Court where the latter has initiated the merger proposal of the two group firms. Essar reacted stating Vodafone had no locus standi to oppose the move as it was neither a shareholder nor a creditor in these companies. Analysts have dubbed Essar's move as an exercise aimed at maximizing the potential value of its stake in Vodafone at a time when telecom valuations are under pressure due to regulatory hangover, controversies related to spectrum allocations, falling call rates and higher than expected 3G cost. Essar would think the value of its stake is higher than $5 billion, while Vodafone believes sectoral valuations have declined in recent years.
  17. Three years on, new telcos fail to connect The Economic Times l 31 Jan l New Delhi Telecom regulator Trai has found that despite a three-year run in the telecom sector, new entrants have failed to make any competitive impact. Trai’s data on market position at the end of November 2010 shows that the combined market share of six new entrants has barely crossed 5% after nearly three years of receiving their licences. On January 10, 2008, the DoT had issued 122 LoIs, mainly to non-telecom firms. Companies that received maximum licences with bundled 4.4 MHz spectrum include Loop (22 circles), Sistema (22 circles), Uninor (22), Videocon (22), Etisalat — earlier Swan (15 circles, including Bihar and MP acquired from Allianze ) and S Tel (6). According to Trai’s , at pan-India level , Uninor has only 2.2% share of mobile subscriber market, while Sistema has 1.1%, Videocon (0.9%), Loop (0.4%), S Tel (0.3%) and Etisalat (0.02%). Mobile number portability (MNP) was seen as an opportunity for new entrants to attract high paying subscribers from existing operators, based on the promise of improved service, customer care and lower tariffs. However , early data belies this hope, as Videocon , Sistema and Loop have lost subscribers so far. Uninor is the only exception with mild gains. With subscriber base and market share at such low levels, it is clear that India’s telecom market is likely to prove impregnable for new entrants. Even before these 122 LoIs were given, India had six to eight operators per circle—the highest level anywhere in the world. The evidence suggests that issuance of new licences has failed to impact the competitive landscape, improve quality of service or even lower tariffs. In fact, the most attractive per second pricing was launched by incumbent operators like MTNL , Tata and Reliance with others following suit. The total telecom subscriber base at the end of November 2010 was 764 million, of which 95% or 729 million were mobile subscribers.
