Swamy moves SC for cancellation of 2G spectrum licences 4 Jan l The Economic Times l New Delhi Janata Party Chief Subramanian Swamy today moved the Supreme Court seeking cancellation of the 2G spectrum licences alloted during the tenure of former Telecom Minister A Raja allegedly in violation of all norms and procedure causing huge loss to the state exchequer. The PIL filed by Swamy sought a direction to the government for holding a fresh auction for eligible entities for all the 122 licences in 22 circles across the country. He alleged the allotment of spectrum, which according to the CAG report has caused a loss of Rs 1.76 lakh crore to the state exchequer, has been sustained despite judgments of the Delhi High Court that struck down the policy of allocating radio waves at the 2001 price on first-come-first-served basis in 2007-08. Swamy's petiton was second after an NGO, Centre for Public Interest Litigation (CPIL), filed an identical PIL on December 14, 2010, seeking cancellation of the licences for 2G spectrum after the apex court decided to monitor the probe into the scam by CBI and Enforcement Directorate. The Janata Party leader in his petition contended the Department of Telecom, then headed by Raja, had arbitrarily and with malafide intention to benefit certain entities advanced the cut-off date for making application for allocation of 2G spectrum from October 1 to September 25, 2007.

SC to waive Rs 25 crore fee on Vodafone's deposit 4 Jan l The Economic Times l New Delhi The Supreme Court said it would waive the 1 per cent court fee on the Income Tax Department , on the Rs 2,500 crore deposited by the Vodafone International Holdings , if the government gives an undertaking that it would not make claim of "unjust enrichments". A bench comprising Chief Justice S H Kapadia and Justices K S Radhakrishnan and Swatanter Kumar expressed willingness to waive off the fee, if the government gives an undertaking before it that it would not make "unjust enrichments" if they lose their case against Vodafone. "If you make statement that we will not make unjust enrichments claims if you lose (then we would)," the bench said to the Attorney General Goolam E Vahanvati, representing the government. The "doctrine of unjust enrichment" has been propounded as an equitable concept created to remedy injustices that occur where one person makes a substantial contribution to the property of another person without compensation. Vahanvati said the stake in this matter was big and he would make statement on Monday, after consulting the government. He further submitted that 1 per cent court fee must be waived off, otherwise in the event of losing the case, the government will pay back Rs 2,475 Crore only to Vodafone. In December, the government had moved an application requesting the Supreme Court to waive the fee for letting it withdraw Rs 2,500 crore, deposited by Vodafone. Instead, it had requested the court to direct Vodafone to submit Rs 25 crore extra, so that the government gets the full amount of Rs 2,500 crore. Vodafone had deposited the sum as court fee for the adjudication of its appeal against the government's demand of over Rs 11,000 crore in taxes for its deal to buy Hong Kong based Hutchison Telecom, which had substantial cellular assets in India through a JV with the Essar group. In 2007, Vodafone, through its group firm Vodafone International Holdings, bought Hutchison Telecommunications India's 67 per cent stake in Hutchison Essar for about USD 11 billion (Rs 55,000 crore). The tax authorities claim that the deal attracts a tax of over Rs 11,000 crore, even though the deal was done by two MNCs outside the country. On November 15, the Supreme Court had directed Vodafone, which is contesting the tax demand to deposit Rs 2,500 crore, along with a bank guarantee of Rs 8,500 crore, before it within 8 weeks for adjudication of its suit. The apex court had also stipulated that the government can withdraw Rs 2,500 crore on an undertaking by the Directorate General of International Tax (DGIT) that if the verdict goes in favour of Vodafone, then it will refund Rs 2,500 crore along with the interest. As the government approached the apex court to withdraw the funds deposited by Vodafone, it was asked to deposit one per cent of Rs 2,500 crore, totalling Rs 25 crore, as commission under a set of rules.

    Rajan Brother, I missed this thread as was on trip to Rajasthan and Delhi. Your Idea is good. No doubts. Merging posts which have similar issues into one thread could be a good option. But its really hard to merge old threads to the new one. On the other hand, new threads, which have similar issues can be merged in one common thread. +1

  12. i have been an extremely happy vodafone customer all my life, the only reason i want to port the number is cause, the new place i m shifting to has very very poor vodafone signal. while the rest of them work just fine. i m thinking of moving to airtel, as it is the only other 1 worth moving to having 3g in delhi. reliance and mtnl are not in my consideration list. Yes Aman, Airtel and Vodafone has the best coverage in most of the cities.

Govt collects Rs 73.73 cr as penalty from new telcos 1st January l The Economic Times l New Delhi The government has collected Rs 73.73 crore as penalty from new telecom operators for missing the network roll-out deadline, but is still keeping open the option of cancelling the licences. "Total penalty is about Rs 219 crore for missing roll-out obligations. We had generated demand for over Rs 78 crore of which the operators have submitted Rs 73.73 crore," Telecom Minister Kapil Sibal told reporters here. Etisalat DB, Loop Telecom, Uninor, Sistema-Shyam and Aircel are among the operators who have submitted the liquidated damages (penalty), the minister said, adding that more notices are going to operators. Asked whether the matter would end with the payment of penalty or licences could still be cancelled, Sibal said: "A decision will be taken after due consideration." Etisalat DB Telecom, a Joint Venture between realty major Swan and UAE-based Etisalat, has paid Rs 9.9 crore for missing roll-out deadline in four circles. The company, however, stated that it was paying the penalty "under protest." Uninor, a joint venture between another realty player Unitech and Telenor of Norway, has also made payment but did not disclose the amount of penalty. Uninor had said that various factors, including delay in clearances required for each site, new last minute pre-launch testing requirements and new equipment security clearance processes, came in the way of roll-out and were beyond the company's control. Sistema-Shyam, a CDMA mobile operator, has also paid about Rs 11 crore to the Department of Telecom (DoT) towards missing the roll-out obligations. All operators are given 15-days time to respond to DoT's notice for paying penalty. The DoT is hoping to get more money in the next few days when the 15-day period would lapse in the case of other service providers. As per the conditions of licence, the licencees are required to roll out the services in 90 per cent of the service area in metros and 10 per cent in district headquarters within 12 months from the date of award of licences. Total penalty cannot exceed Rs 7 crore per licensing area and the telecom companies get 52 weeks before their licences are cancelled.
