Computer major Dell India has been issued notice by a district consumer court for allegedly over pricing products and supplying a faulty laptop to a customer. A consumer court in Shalimar Bagh, while issuing notice to Dell India earlier this week, asked the firm to file its response by December 21, the next date of hearing. The court was hearing the plea of Archer Softech Pvt Ltd through its advocate Ankur Raheja, who alleged that the Dell Inspiron 6400 laptop it bought for Rs 69,164 turned out to be faulty. He also said that the company was not ready to replace or repair the product. "Except the hard-disk and processor (which are of Toshiba and Intel make, respectively ), almost each and every part has either been replaced or is not functioning properly due to manufacturing defects and poor quality of spares supplied for the laptop," Raheja said. He added that his client had to run form pillar to post to get spare parts for the laptop and its servicing, which also resulted in loss of business. He has demanded that the company return the amount paid by the consumer for the laptop and a compensation of Rs 400,000. The complainant also alleged that Dell is over-pricing its products, charging consumers much more than the maximum retail price (MRP). "There is no doubt that Dell India's aim is not just profit but extraordinary profit by exploiting Indian customers. That is why the prices for laptops and especially parts are always charged on the higher side in India," Raheja said in the complaint. He said that the company had charged much more than the MRP for a battery. The cost of the battery, printed on the box, was Rs 2,100 but the company charged Rs 5,152, he alleged. "We have contacted the company on many occasions but lame excuses were provided by the irresponsible staff. And on some occasions, no response was received," Raheja said. Hi Arun, glad to know you never had any problem... But this Laptop had Monitor, Keyboard, Mouse Pad, Wireless, DVD ROM, Battery (once in warranty), Adapter changed during the first two years of warranty. In addition, more repairs were carried out... Further, Keyboard and DVD-ROM not working properly since last 6 months, for which they never sent in... any engineer but these days they only email troubleshooting steps, even after repeated requests after troubleshooting steps were performed. Though this was not the case in the first two years of Warranty... !!! The 3 years complete-cover warranty expired on 30 June 2009 only. Anyway, the main issue in the matter is... HOW A COMPANY CAN MAKE A SALE OVER THE MRP ? The battery box reads Rs 2,100 as MRP (inclusive of all taxes) but Rs 5,152 was charged under invoice, though no other services were availed with it like engineers visit ??? This is interesting authorotative decision.... Sell at MRP or pay fine, says court - Rejecting an appeal filed by fast-food chain ‘Nirula’s’, Commission president JD Kapoor said, "If any complaint of this nature is received in future, the culprit shall be visited with heavy punitive damages running into lakhs which may drive them out from selling such articles or goods."

Just to update... my Samsung MAX phone again became dead in December end... i.e. for the second time during warranty, so have filed for recovery of the price paid in Delhi's consumer court !

I have recorded some conversation on my Samsung Mobile. Can anyone tell me... how can I make a backup of such conversation to my Computer. I have tried through SAMSUNG PC Studio... but no such files are visible ???

No case... until something again happen to mobile within the warrnaty period... this time only a notice asking them to explain will suffice !!!

Thanks a lot for the reply... It seemed doubtful... as the same person gave this version that we have replaced the Mother Borad, who a day before said -> that we dont have any idea, what exactly has been done with your mobile. And we dont have any information from HO. I also dont agree that they would have taken the backup, otherwise more data should have been there like Contacts Pics, etc. Further, as today I have recorded the words of Samsung employee Mr Anuj Verma in Audio that new Mother Board has been replaced, and on the other hand I have evidence in the form of old SMS in the mobile... need to do something

Veyr right... dont buy... MAX !!! Mine was dead on 45th day of purchase... and even customer care is fooling customers. Can some one clear my doubt... its important... " If MOTHER BOARD of phone (Samsung Max) is changed... whether the data of phone would get deleted specially SMS messages " ??? As SAMSUNG company has now claimed, that we have replaced... MotherBorad of your phone ! But on the other hand... all the old SMS were intact in the phone.

No they did not take any signature anywhere while handing over the instrument... and the person at service center, who was giving big assurance a day before... Said: "we dont know what was wrong with the Instrument... he further added we are not informed by the Head Office as to what was wrong or what has been replaced, just that your Instrument is working now" !!! A day before, the same person assured me on asking for a new instrument... that dont worry, there won't be any repairs. There was some major problem, so there would be a replacement probably of Mother Board, and a new part would be replaced in your presence... and nothing of the sort happened... !!! Nokia Service Center, everytime lets customer know, what exactly is wrong...

So i got back the mobile... it is really strange that Smasung is afraid to disclose the reason... as to what went wrong with the mobile or what part is replaced ??? Really a Bad Experience overall... with the kind of commitment and promises that were made, when I asked for replacement of Instrument... Big Liars !!!

Nice decision... !!! I must admit... Reliance communication's advocates have been trained to make consumer suffer in Consumer Court too... as they keep on taking dates. My Dad filed a case in consumer court in May 2005... and later due to his death in 2007, case was transferred in my name. And it's been three years and still no decision... though last hearing was on 17 March 2008 And even on last hearing I had requested to go ex-parte as Reliance advocate was again absent... I think what Reliance Advocate strategy in consumer court is to make consumer give up !!! -
Thanks for the reply Kamal I asked them to replace the same... they said it won't be replaced !!! Ya faced some issues with NOKIA also in the past... But Nokia was better in this part too... as previously I had Nokia 6255, I used to face frequent switch off problems with it... and sent it for repairs thrice in guarantee period. And the result was replacement of the instrument with a 6265 instrument... which is going good and its still in use too. Will try to communicate in writing with Samsung Company... maybe if they can replace it !

I bought this instrument on 29 April '08 and it became dead on 12 June '08... local service center unable to find out the reason for the same. The phone has gone for repairs to HO... Bad decision... to go for a Samsung rather than NOKIA...

I think when we file the case.. we have enough evidence with us... on the basis of which we make our case. And further consumer case is not that big issue that company will sue you back... I have never seen this happening atleast in Consumer Cases.

Mainly time is spent in intial preparation of the case that is to be filed, maybe few days to a weeks time... depending upon how long or how complicated matter is ! Then for every court date, you need to spare half day's time, which may come every 2 mnths time (approx) in a district consumer court. And you may have to appear 5-10 times in the court in 1-2 years time. The other formailities are filing rejoinder (reply) to the Opposite party's reply submitted in the court. And before the deciding of the case, court will ask you to file the complaint in the form of affidavit. These have to be prepared too... otherise in between you just have to appear and make the court aware of the complaint. And last stage is argument, which you have the option of filing it in writing! But there are exceptions also... like initially after filing of the case, opposite parties try to compromise, if they think there is enough proof against them or at the first hearing... court will try to make parties come to some kind of settlement. Money spend includes Rs 100-200 (depending upon the compensation claimed) in the form of Postal order initially and money spent in commuting to the court.
