NEW DELHI: Telecom regulator Trai on Monday said all calls from national roaming subscribers will be treated as STD calls while that of global roaming users will be accounted as incoming international calls for Access Deficit Charge calculation purpose. All calls from the National Roaming subscribers shall be treated as Long Distance calls and all calls from International Roaming subscribers shall be treated as incoming international call for ADC purposes. As such for all calls from National roaming subscribers while in different Service Area, ADC charge as applicable for National Long Distance calls shall be applicable at the rate of Rs 0.30 per minute. International Roaming Subscriber while making any call while in India, an ADC of Rs 3.25 per minute shall be applicable. For all calls from Roaming subscriber, the access deficit amount is to be collected by the visited network operator and paid to BSNL Defining the national and international roaming calls for the clarity in calculating the access deficit charge, TRAI said "It is national roaming when visited network and the home network of the subscriber are in the same country and it is international roaming when visited network and home network of the subscriber are in different countries, subsequent to this definition, applicability of ADC on calls originated from national and international subscribers will be accordingly. With this TRAI has further amended the Telecommunication Interconnection Usage Charges Regulation, 2003(4 of 2003). Roaming means the ability for a cellular subscriber to automatically make and receive voice calls, data and to access other services while traveling outside the geographical coverage area of the home network, by using the visited network.

Infocomm denies tapping phones April 07, 2005 21:49 IST Reacting sharply to reports that Reliance Vice Chairman Anil Ambani had sought a government probe into tapping of his phones by 'unscrupulous individuals' working for Reliance Infocomm, the company has denied the allegations vehemently. 'We are shocked about the reports in a certain section of the media about a letter allegedly written by Anil Ambani to the Home Minister seeking a probe into alleged tapping of his and his personal staff phones,' the company said in a statement. 'Reliance Infocomm categorically denies any attempt by the company or its officials to tap anyone's phone, much less that of Anil Ambani or his office,' the statement added. 'The allegation is baseless and malicious and the company strongly refutes the same,' Reliance Infocomm said.

There is no connection between the ISP's internet service (even if it is Reliance or any other) and the SMTP server that you are using, and you say that the mail is going through without any problem. It could be something to do with Sancharnet's email server. -
Three players in the wireless telephony market, namely Reliance, Bharti and BSNL, account for over 60% of its share, while the top five players account for over 80%. Thus, though the wireless market has twelve players, it is concentrated in the hands of a few. Bharti Cellular, BSNL, Hutch, Idea Cellular and Reliance are the leading five. Their total market share amounts to 84.6%, thus leaving less than 20% for the other seven players. The latter group includes Aircel, BPL Mobile, HFCL Infotel, MTNL, Shyam Telelink, Spice Communications and Tata Teleservices. As per the latest data, while Reliance had a presence in 22 circles in February ‘05, Bharti and BSNL followed with 21 and 20 circles respectively. However, an extensive presence does not necessarily amount to a significant market share, as in the case of Tata Teleservices, which has a market share of just 2.2%, despite being present in 19 circles. On the other hand, Hutch and Idea, which have a market share of more than 10% each, have a presence in just ten and eight circles respectively. In addition to an extensive presence, Reliance also had a subscriber base of 10.95m in February ‘05. It was followed by Bharti with a subscriber base of 10.66m. The other wireless players have subscriber bases below 10m. With regard to market shares, Reliance has the highest, at 22.1%. Bharti is close with 21.5%, and BSNL comes in third with a share of 17.8%. Hutch and Idea Cellular have market shares of 12.9% and 10.2% respectively. Among the smaller players, Aircel has a market share of 6.1%, followed by Spice Communications and BPL Mobile, with 3% and 2.4% respectively. Barring Tata Teleservices and MTNL, the rest of the players have market shares below 1%. Compared to the market shares for December ‘03, those of BPL Mobile, Reliance and Spice Communications have fallen, whereas those of Hutch, Idea, MTNL and Aircel have increased. As per December ‘03 data, Idea had a market share of just 8.5%, whereas the figure for Hutch was 11.2%. The top five players being the same as current, constituted a total market share of more than 80%. At present, Aircel Digilink and BPL Cellular are present in four circles each, whereas MTNL and Spice Communications are present in two each. On the other hand, HFCL Infotel and Shyam Telelink are present in one circle each.

RNEW DELHI: Good news for yakkers. Your mobile and fixed line phone bills could see a further drop . The government is looking at a proposal to lower the service tax rate on telephones following a recommendation from the Telecom Regulatory Authority of India (Trai). A 10% service tax is charged on phones now. The regulator has, however, not backed the telecom industry's demand to scrap a plethora of charges such as licence fee, spectrum charges and instead, merge them into a single service tax levy. The overall tax burden on mobile service providers is around 17% to 24%. Finance minister P Chidambaram has already indicated that the taxation structure in the telecom sector will be simplified in the coming Budget. Telecom biggies including RIL chairman Mukesh Ambani and Bharti group chairman Sunil Mittal had made out a case for a single, lower levy to reduce the overall tax incidence and the cost of compliance in their pre-budget interaction with the finance minister. The single levy, according to them, could be in the form of service tax. "We are of the view that the overall tax burden of the industry should be lowered. But all the levies cannot be clubbed into a service tax at this stage. Imposts including licence fees, access deficit charges, universal service obligation fund and service tax have to continue separately for sometime. As an interim measure, a lowering of the service tax levy to, say, 5% can be considered," Pradip Baijal, chairman, Trai told ET. evenues from service tax form a part of the divisible pool of taxes that are shared with states. Currently, states get a 29.5% share of pooled central taxes based on the Eleventh Finance Commission's recommendations. While the proceeds from licence fees and spectrum charges go to the Centre, the USO charges go to a dedicated fund to finance the spread of telecom in commercially unviable rural areas. None of these are shareable with the states. Neither is ADC, which goes to BSNL and MTNL. It is a charge levied on telecom services firms to fund the state-owned telecom operators' loss-making investments made on social, rather than commercial, considerations. An ADC of Rs 2.50 per minute has been proposed to be levied on ISD calls and 30 paise per minute on STD calls, with effect from February 1. Trai's recommendation to lower the service tax burden is significant in the context of Mr Chidambaram's promise to simplify the tax structure for the telecom sector. However, the revenue implications are being weighed as telecom accounts for almost a quarter of the budgeted service tax revenues of Rs 14,150 crore in the current fiscal. The tax burden of 17% to 24% covers a 10% service tax plus sales tax levied by a few states, 5-10% licence fee and 2-6% spectrum charges. USO charges are included in the licence fee. In contrast, the overall tax burden in China is around 3.5% including spectrum charges of 0.5%. The incidence is far lower in Sri Lanka and Pakistan compared to India

AFTER blowing the whistle on Reliance Infocomm's illegal routing of long distance calls, Bharat Sanchar Nigam Ltd has now lodged a complaint with the telecom regulator against Tata Teleservices for avoiding payment of Access Deficit Charges by allegedly offering mobile services under the garb of fixed line telephony. Private cellular operators have also sought the intervention of the regulator in this matter. In a letter written to the Telecom Regulatory Authority of India (TRAI), BSNL has said that Tata Teleservices was enjoying the benefits of a fixed line service operator even as it was offering services called `Walky' which was essentially a limited mobile service. Fixed line operators are not only exempt from paying ADC but also receive ADC for calls terminating on its network. On the other hand operators offering mobile services are required to pay deficit charges ranging between 30 paise and 80 paise per minute. BSNL has alleged that though Walky was a mobile service, Tata Tele was claiming ADC as if it was an extension of fixed line telephony. In another letter, the Cellular Operator's Association of India (COAI) has written: "The situation is becoming a severe non-playing field issue vis-à-vis the cellular mobile service providers since the mobile Walky appear to be enjoying landline benefits. Additionally, BSNL is also being severely disadvantaged since they would not receive ADC from the Walky calls." Mr D.P.S. Seth, Member, TRAI, said that the issue is being examined and a decision would be taken very soon. Tata Tele has been projecting Walky as mobile services at landline rates in its advertisement. The Tata Teleservices spokesperson, however, said that the company had not received any communication in this regard and was complying with all guidelines as stipulated by the authorities.
