raccoon 53 Report post Posted September 13, 2008 (edited) That is no consolation! They are legally, ethically and morally bound to give exactly what is advertised! Anything less than that is fraud!! Saurav, you should escalate the matter to Virgin's Nodal officer and then to their Appellete authority. Also send a complaint to TRAI and DOT's Consumer Grievance Cell. This is not likely to result in any concrete action, but you should still do it... its free anyway... If you want to do something concrete then a Consumer Court is your only option. Save the webpage both in soft and hard copy. Send it with all your complaints. Try sending a complaint to the MRTP Commission also.... as this clearly mounts to unfair trade practice. But I'm not sure if they handle telecom issues... no harm at all in doing it anyway... Don't give up! They should be fined for such frauds... don't forget to mention in your complaints that they are commiting this fraud with thousands of other customers too!! Honest 836 Report post Posted September 13, 2008 ^^^ Yes, I too agree with Raccoon here. We should not let these operators do whatever they like to. My dear Saurav you should ask them for extra benefits as compensation above those which were mentioned in their website. I hope you will notonly get the benefits as described by them in the website but an extra will defienetely be their for toping up the case. Don't give up my dear friend. Just think, If you were a postpaid subscriber and you didn't pay their bills. Just imagine what did they had done to you. Now its your chance, you must encash this chance my dear friend. Regards. Sadikk 301 Report post Posted September 14, 2008 If u go consumer court, u have them by balls. The case is urs, also sue them for extra amount, charges of advocate and all.
nellorian 23 Report post Posted September 14, 2008 This comes under Consumer Protection Act and also comes under UNFAIR TRADE PRACTICE. The options let open to you is 1. to file a complaint giving full particulars about the web page which makes you to purchase the handset and not crediting the free talk time. You can also pray for damages for wrongful advertisement and mental agony also. Be clear and it should understandable to the presiding officer of the Consumer Forum and it's members. Most of the cases are defeated for non mentioning of the facts clearly. You can also send a petition to MRTP Commission.
Puneet 0 Report post Posted September 14, 2008 Where has the old wisdom of confirming such offers from dealer/shop/customer care before taking the final plunge of putting in your moolah lost these days? Anyway, raise a complaint everywhere, and Consumer Forum is you best bet. Take a pic of the webpage today only with today's newspaper - to keep a a record that was advertised at least till today Virgin Mobile is soon gonna take off the page... commonman 228 Report post Posted September 15, 2008 The VSleek offer is available on the Virgin Website for quite sometime. But the price quoted had been 4799 every time i have checked and it is 4799 even today. http://www.virginmobile.in/phones_special_offers_vsleek.html So was the price of 2999 a special "error" in the website for some specific time? Saurav 22 Report post Posted September 15, 2008 (edited) I got reply from virgin First of all the offer that was mentioned on our website was only for a limited period. Unfortunately when you purchased the connection, that offer was no more valid. That is the reason you are now not entitled for that scheme. However because you saw the offer on the website and purchased the connection, we would like to compensate this error by sending you a surprise Virgin Goodie. I hope we are able to avoid such errors in future. My reply I will like to bring the following to your kind notice:On your website noting regarding the date was present. I purchased the handset on 12-Sept-2008 the same offer was available on your website and no expiry date was mentioned. Pdf print of your offer i attached herewith for your reference. The same offer was present on site on 13-Sept-2008 as well as on 14-Sept-2008. It was removed from your website only on 15-Sep-2008. So I am ELIGIBLE for the offer as mentioned on website on 12-Sept-2008. Why should I suffer because of your error. Regarding your surprise Virgin Goodie, it has not to be compensation for benefits in the offer. But If it has to be compensatory then it has to be of my Choice and equivalent in value to your offer. Commonman if they have commited mistake they have to pay for it. If I commit a mistake of not paying my Mobile Bill, Will any operator spare me?
