Court Summons Ambanis On Local Lawyer's Complaint

A court here has issued summons to Mukesh and Anil Ambani, chairman and vice chairman respectively of the Reliance group, India's largest private company, on a suit by a local lawyer who has accused its telecom arm of fraud.

Patna judicial magistrate O.P. Srivatav summoned the Ambanis on a complaint by Sobha Jha, who said she had received a bill of Rs.100,667 from Reliance Telecom for five mobile connections she had never applied for.

She said Reliance had threatened to take action against her if she did not pay up. She said the company had refused to respond to her repeated pleas.

A Mumbai court has issued summons against industrialist Mukesh Ambani, his brother Anil Ambani and seven others following a complaint by a local resident alleging that he was getting Reliance cellphone bills although he was not a subscriber.

Additional Chief Metropolitan Magistrate D A Joshi issued the summons on August 19 on the complaint filed by Dinesh Kotecha and asked the respondents to appear in person within 90 days as a prima facie case was made out against them.

Kotecha's lawyer Niranjan Lapsia submitted that his client had received the first bill for the month of December 2003 following which he registered a criminal complaint with V P Road police station against Reliance Infocomm, Reliance Industries and Reliance Communication and Infrastructure Ltd.

Kotecha, however, kept receiving bills for the next five months and so he registered another complaint but there was no action.

On June 7 this year, Kotecha alleged that he was threatened by two persons who asked him not to lodge complaints and pay the dues.

Kotecha then issued a legal notice to Mukesh Ambani, chairman and managing director of Reliance Industries; Anil Ambani, vice chairman and managing director, Reliance Industries; Vinod Ambani, company secretary, Dilip Derai, executive director, Reliance Infocomm; and Satyapal Jain, chairman, Reliance Infocomm.

The notice was posted by the registry on June 9 but there was no reply and further bills kept coming following which Kotecha filed the complaint before additional Chief Metropolitan Magistrate, Girgaum court.

The court took cognizance of the complaint on August 19 and issued summons against the persons named in the complaint under Section 384 read with 34 IPC.

Anil (ADA) is not even involved with Infocomm at all!

Finally all their lawyers can wake up and get to work to earn their retainers.

Kotecha stated that after he got the first bill in December 2003, he filed two police complaints and sent two complaint letters to Reliance. He says he did not get a reply to either.

Next, he dashed off a legal notice. Kotecha said that all he got in return was two more bills in the mail.

By May 2004, Kotecha had received six telephone bills for two Reliance numbers 34393267 and 34393318. The bill amounts varied from Rs 6,347 in December to Rs 33,182 in May for one phone and Rs 3,627 to Rs 6,412 for the other.

On June 7, states Kotecha, he received a surprise visit by two ‘‘persons from Reliance’’ who allegedly threatened and intimidated him to pay the ‘outstanding sums’.

His went straight to court. Kotecha writes in his complaint: ‘‘Those two persons, in a loud tone, threatened me and told me that their master is a big person and they can do anything to me and my family members.’’

His complaint further states that the incident has gravely affected him and his family besides defaming him in public.

He has asked for Reliance Industries, its board of directors, chairman, managing director to be charged under Sections 420, 463, 467, 499 and 500 of IPC, including offences of cheating and defamation.

A spokesperson for Reliance Infocomm Ltd, Jimmy Mogal, told Newsline: ‘‘Our legal team is examining the matter. There can be no comments, since the matter is subjudice.’’

The matter will now come up for hearing in three months.

If not challenged in higher courts, the Ambani brothers would have to be present for Kotecha’s case at Girgaum in person.

Tata Indicom has also come under fire from its customers for faulty billing and bad service. Ankush Tambe from Goregaon (consumer No. 500105566) was sent bills twice for the month of May on the 4th and the 23rd. The invoice number was the same. Kirit Gore, fed up with the service provider, completed the formalities for surrendering the line on July 31. He was told that it would be disconnected within two days, but to no avail.

When asked, Debashish Sur, Head (Customer Care), Tata Indicom, told Express Newsline: ‘‘All the complaints have been taken care of.’’
