ravi_patent 28 Report post Posted March 31, 2009 31 Mar 2009, 1158 hrs IST Press Trust of India Telecom tribunal TDSAT on Tuesday upheld the Government's decision to allow Anil Ambani Group company Reliance Communications to use dual technology (CDMA and GSM) for offering mobile services throughout the country. Hearing a petition filed by the Cellular Operators Association of India (COAI) challenging the government's decision, the Telecom Disputes Settlement and Appellate Tribunal (TDSAT) also said that GSM operators have no right to get spectrum (radio frequency) beyond 6.2 MHz. KumaarShah 143 Report post Posted March 31, 2009 What could have happened if TDSAT had not allowed the dual services? RCOM has already launched GSM services almost all India now. Would they have had to withdraw the services? Or would they approach the SC? And similarly the opposing parties also can still approach the SC, AFAIK. Thats exactly the reason why the services were launch "6months ahead of schedule". They had resorted to the same trick during the CDMA launch. Remember the "Monsoon Hungama" offer for Rs. 501? This was aimed at attracting more and more customers to Reliance Infocomm subscriber base. The court then had almost come to the conclusion that the entry of Rel Infocomm was not through legal channels offering full mobility services through the CDMA technology. Reliance, then quickly increased their subscriber base through the Monsoon Hungama and made a case for the almost one million customers on their network at that point of time. It was only after this contention was accepted by the court that Reliance had to pay the requisite fees of Rs. 1651 crores along with a hefty fine for offering Full Mobility services. This is also an action replay, GSM services were launched ahead of schedule so that even if this case was lost, they can make a case for their millions of subscribers, and they can get away with paying a fine and other penalties. Definitely we can expect some more publicising of RGSM in the near future. But this cannot be attributed to this judgement. RGSM had not resorted to publicity stunts for the launch and advertisement of their GSM services because the Customer Experience Pack (CEP) was revenue negative, and added to that the advertisement costs would have cost RCOM dear. I think with the eventual phasing out of CEP, and introduction of long term tariffs, definitely RCOM will step on the gas to advertise its GSM services nationwide.
