Is This A Scam?

Recommended Posts

I got a call today from a Mukesh Sharma [MS] claiming that a legal notice has been filed against me in delhi.

He insisted on me calling a specific lawyer SK Oberoi [sKO] to find out what the notice was about but claimed he was not authorised to open any case.

He provided a 'file #' as reference for SKO @ 96169 18652.

It just sounded so weird that I ignored his calls after that.

It almost sounds like Mukesh gets paid by SKO for referring cases to him or something since he called thrice in an hour.

Just wondering if anyone has ever got any calls like this before about notices in another city...

I thought we had a right to know the accusation in any legal matter without payment.

It alsmost felt like SKO would be asking me for some 'nominal charges' to open the file so I refused to call him.

However, Mukesh had my full name, mobile, and mailing address which he verified so I'm not sure.

MS called from 80810 72132.

He also said the notice had been sent 15 days ago which of course I never got.

Its 100% scam.

Mostly this technique is used by telecom operators to recover the pending bill amount.

One of my colleague owed Rs.2500 to airtel. He didn't pay and then airtel tried everything but he ws still adamant abt nt paying.

Then they applied the courier technique to know his present address (he lives as a tenant in city).

When everything failed, they somehow tracked his no. and someone called him saying that he is from tis hazari court and airtel has initiated legal action against him and all this was pure bluff as we screwed that guy to hell. He was so afraid that he told us that he works for a airtel recovery agent.

@City02

My dear friend, to me it seems to be a SCAM for sure.

If ever any legal authority issues a Notice to anyone....it reaches the person either by Registered Post or by UPC (Under Postal Certificate).

In your case, if this person tries to call / harrass you again, then you should either make a Police Complaint against him or just put his number in the BLACK LIST of your mobile.

I never heard any Lawyer or any person informing the accused party by phone regarding legal notices.

So, enjoy buddy.....!

Cheers !

Some junior lawyers read notices/summons/cases in the courts and try to contact the person,if he has given you a case no try to find out from the court if there is a case filed against you.As for the ownership of the number, there are sim cards preactivated with free talk times at throw away prices people buy them just to make calls so dont come to any conclusion on basis of that, just try to find if anything is in your name without meeting them.

I am saying this because few years ago a case was filed in my name by american express and there I was not aware of it and someone like this contacted me and I was able to contact Amex asking them why the case and got it solved here in Mumbai itself or else I would have been served with an arrest warrant and would be running here and there to secure bail etc....

Dont take it as a prank/scam call, just find out maybe it can save your time and money later.

What's strange is how desperate Mukesh seems for me to call Oberoi, instead of calling me 4 times he could just have oberoi call me directly instead.

Are there any special/premium numbers where we get charged more than the normal rates for calling?

Just like premium SMS numbers...

I hope its not an actual notice.

Can you get picked up in Mumbai for a warrant from Delhi?

How does the jurisdiction of the local courts work?

Can you get picked up in Mumbai for a warrant from Delhi?

How does the jurisdiction of the local courts work?

yes you can get picked up in Mumbai for a warrant from Delhi

and its not related to your staying place, if case is filed against you in Delhi you have to be present in Delhi court.

if it is related to business then case has to be filed in jurisdiction of that business area.

personal case can be filed in any court. subject to other party's residential area.

Very true hitesh!!!

Even anticipatory bails are limited to region now. I mean, if u get an anticipatory in delhi, it would be of no use if case is filed in mumbai under mumbai court juridiction.

No more blanket anticipatory bails!!!

Don't know what ws the point in changing and implementing such a bail system!!

In case the defendant / accused wins the case filed, can we collect damages?

e.g., costs of going to delhi & engaging lawyers etc.

Is a legal notice the same as a case being filed?

Today I got a call from some lady lawyer from number 8860140753 saying that she is from tishazari court in Delhi and a case has been files against me by Reliance for not paying a bill of Rs 1183 on my number which I had stopped using since 2006. ( How she got my new number I don't know) I asked why was I not sent a notice She told it was sent but I had refused to accept it She had my address details also She had called at 3 pm and told if I want to sort out the case I should pay the bill by 4 PM in any reliance outlet otherwise I will have to pay a fine of Rs 15000 and some other punishment also.

I stay in Nagpur she again called me at 4 pm to confirm whether I had paid or not Can a lawyer contact me like this or is it a scam.

Seems like its dead money recovery.

I have 3 Reliance Postpay (2 CDMA + 1 GSM) all on same name & billing address, but different CIF#. For GSM I got a bill of Rs. 5400 which I did not pay. Till now have not received any notice or any calls & the number has been terminated (Checked with WebWorld). And other 2 numbers are working till date.

If I am not wrong, there is a period of limitation is 3 years after which no legal process can be initiated on any claims. so if your bill is of 2006 that makes it 5 years old.may be next time she calls up you should ask her to leave her contact details and office address so that "your lawyer" can contact her.
