amitbt22 2 Report post Posted October 22, 2005 NEW DELHI: Bharat Sanchar Nigam Ltd, the biggest telecom network in the country, was allowed by the Supreme Court to raise bills against private mobile operators at the rate of 19 paise per minute for landing calls from their network to its mobile network ‘Cellone’. The SC, however, restrained BSNL from actually recovering the money. A Bench comprising Justices Arijit Pasayat and Arun Kumar passed this order while admitting BSNL’s petition challenging the May 3, 2005 order of the telecom disputes settlement appellate tribunal (TDSAT). TDSAT had held that the telecom PSU was not justified in charging 19 paise for transiting of the calls of private cellular mobile service providers (CMSPs) on its basic telephone network before landing them on its cellular service ‘Cellone’. BSNL said TDSAT had accepted its contention that PSU had created and augmented its network both before and after National Telecom Policy-1999 to facilitate transit of calls originating from CMSPs, since such transit was mandatory before NTP-99. The transit charges were merely a means for BSNL to recover its costs for the work done by it in augmenting and creating the network for transiting of the calls originating from its network.
