Bharti refunds subscribers on TRAI order

Complying with a directive from regulator TRAI, Bharti Televentures, which operates AirTel mobile services, has refunded Rs 32.73 crore it levied from subscribers for migrating to revised tariff plans.

The operator had collected a one-time fee ranging from Rs 50-Rs 200 totalling Rs 35.49 crore from existing subscribers for switching to revised plans with lower charges, a TRAI statement said .

Charging such a fee is in violation of the provisions of Telecommunication Tariff Order, 1999. Accordingly, TRAI issued a direction, asking Airtel to refund the migration fee charged from the subscribers.

The statement said the difference between total refund due and total refund made was Rs 2.76 crore, which would be put in separate dedicated accounts.

he authority also directed Airtel to give wide publicity in the media/newspapers so as to enable the customers to avail the benefit of the refund ordered by TRAI.

The fee charged consequent to the revision of pre-paid and post-paid tariffs by Bharti Tele-ventures Ltd (Airtel) in August 2004 in its 16 licensed areas of Delhi, Mumbai, Punjab, HP, Haryana, Uttar Pradesh (West), MP, Maharashtra, Gujarat, Kolkata, Chennai, Tamil Nadu, Kerala, AP, Karnataka and Rajasthan.

Bharti firm pays Rs 16 lakh to BSNL

The landline and broadband division of private telecom major Bharti Tele Ventures Ltd (BTVL), which offers services under the Airtel brand, has paid to Bharat Sanchar Nigam Limited (BSNL) a part of the penalty amount for causing damages to the latter’s underground cables in Chandigarh.

BTVL, which has been laying underground cables across Chandigarh for the past few months, has paid Rs 16 lakh to BSNL for causing extensive damages to BSNL’s cables across the city.

Airtel paid the amount after demand notes were issued to it by BSNL for the damages caused mostly between July and September.

BSNL’s commercial section has also issued demand notes to Airtel for about Rs 23.57 lakh more for further damages caused to BSNL’s underground cables by the private company till November 7. “The damages to our cables still continue and we are issuing further demand notes to recover the cost from Airtel,” said a senior BSNL official.

Some of the major damages to BSNL cables caused by Airtel’s underground digging and boring include damages at 28 locations in sectors 34 and 35 on July 15; damage to over 100 pairs of cables in Sector 21; and damage to 50 pairs of cables in Sector 27-D on July 22, said BSNL officials. Airtel paid up on October 4.

BSNL’s latest nine demand notes for Rs 23.57 lakh to Airtel for damages till November 7 include major cable cuts like those in Sector 18 and in Sector 19. ‘‘We are trying to recover the costs as per the damages caused to our underground cable network,’’ said BSNL’s GM (Telecom) HR Verma.

Airtel Broadband and Telephone Services (ABTS) CEO (Punjab Circle) Rahul Mehta said, “the damages to BSNL’s cables have been due to BSNL’s failure to provide us updated diagrams of their underground network.”

Mr Verma refused to comment on this allegation.

Two other telecom companies — Tata Tele Services Limited and HFCL, which offers telecom services under the Connect brand — have also damaged BSNL’s network. While HFCL has to pay Rs 92,500, Tata has been issued demand notes of Rs 3.16 lakh.
