There is a news from chennai that cricket scores coming in web site and mobile phone are banned by an order issued from Madras highcourt

didn't got the details

any one having news....

Yeah they were talking about some chennai based company that had bought the exclusive rights from a Pak firm and TN HC has directed MSP to stop sending SMS alerts to consumers.

I am not sure aboout websites.

How can they stop it?

I mean why such stupid restrictions?

The Madras high court on Tuesday restrained mobile phone service providers across the country for four weeks from giving any SMS pertaining to the ongoing One-Day International between India and Pakistan.

Giving the interim-order on a civil suit filed by M/S Marksman Marketing Services Pvt Ltd, Justice M Chockalingam said, "The court was of considerable opinion that it is a fit case for an ad-interim injunction. Ex-parte has got to be granted."

The judge held that the "balance of convenience" was in favour of the applicant.

In the civil suit, the applicant contended it had secured the rights of disseminating information relating to scores, alerts and updates or other events or happenings of the tour through SMS.

The applicant had secured the rights from Pakistan-based Vectracom Pvt Ltd, which had entered into an agreement with the Pakistan Cricket Board on December 29, 2005, with respect to exclusive global SMS rights of the Indo-Pakistan series.

The petitioner submitted that during the recently-concluded India-Pakistan Test series, it was noticed that cellular phone operators were disseminating information related to scores and updates through SMS to their subscribers allegedly without obtaining permission from Vectracom.

The applicant apprehended that cellular phone companies across the country would also provide information relating to scores and updates of the ODI series too, without obtaining permission.

The respondents were "exploiting the rights of the petitioner in a commercial way and earning huge profits," the applicant contended and said if the cell operators were allowed to provide such information, "commercially, the petitioner alone was responsible for any loss to Vectracom and the Pakistan Cricket Board".

The petitioner said by transmitting scores "instantaneously and contemporaneously", the defendants were indulging in "almost large scale pirated transmission of live instant information".

The defendants mentioned in the suit were -- Bharati Televentures Ltd, BSNL, Reliance Infocom Ltd, Hutchison Essar Ltd, IDEA Cellular Registered Office, Aircell Cellular Ltd, Aircell Ltd, Spice Telecom, Tata Indicom, Sify Ltd, Yahoo Webservices Ltd, India Times, IMI Mobile, Phony Tunes.com, Rediff.com India Ltd, Pyro Mobile Pvt ltd, ON Mobile Asia-Pacific Pvt Ltd, CricInfo India, BCCI and TRAI.

Yes only the SMS things are been banned.......... so frm no onward u wont get the scores on mobile no even in the Rworld.................

They have rt to do tht since they have taken the exc. rts for it.

Its the same way wth wht happpens with the TV rts.

In RWorld go to RSurf, open Indiatimes, check ur score!! :( so it is not entirely blocked for mobile users :(

Not related to this, since last week I am not getting the RSurf menu in rworld in my 5130.Anybody else facing the problem?

Court lifts stay on SMS scores

The Madras high court on Saturday allowed cell phone operators across the country to provide scores of the ongoing India-Pakistan one-day international cricket series through SMS.

Justice R Bhanumathi gave the interim order on a batch of 18 petitions filed by mobile service providers, including Bharti Televentures and Hutch, challenging a February 7 order by another judge of the court restraining them from providing score updates through SMS.

Earlier, Justice M Chockalingam had, on February 7, passed the interim stay order, effective for four weeks, on a civil suit by Marksman Marketing Services Private Limited.

Justice Bhanumathi said if ultimately the suit goes in favour of Marksman, the company could be compensated and it would not suffer any loss.

She directed the cell phone operators to maintain strict account of the revenue earned through the score SMS of the one-day internationals.

Marksman had contended it had secured the rights of disseminating information relating to scores, alerts and updates or other events or happenings of the tour through SMS.

The Cellular Operators Association of India (COAI) has slapped a counter notice to the Board of Cricket Control in India (BCCI) over offering cricket update through Short Messaging Service (SMS). The association has also filed a caveat in the court as pre-emptive move in case the BCCI decides to file an appeal.

Earlier, the BCCI had issued a legal notice on mobile operators for offering cricket updates of the ongoing India-England series to their subscribers through SMS. Cellular operators, however, are contesting BCCI's rights over all information relating to cricket.

The BCCI notice had also asked operators to refrain from similar activities in future without obtaining prior permission of the board. BCCI said that cellular operators could get into a commercial agreement with the cricketing body; otherwise it led to unauthorised violation of BCCI's rights and illegal interference with the its legitimate business.

But cellular operators are in no mood to cough up any money or share the revenues generated from the service. Most operators charge a premium rate of Rs 6 per update.

The BCCI notice stated that the Indian cricket board had exclusive television rights, Internet and SMS rights and all other similar rights for all test and one day matches played in India. The notice also said that operators were continuing with the live updates despite being aware of the recent interim order passed by the Madras High Court.

Cellular operators, however, said that BCCI was misusing the judgment to create confusion in the matter. They have also filed an appeal against the order of the High Court.

Cricket is not your property, COAI tells BCCI

In a new twist to the row over sending cricket updates through SMS, Cellular Operators Association of India (COAI) has questioned the authority of the Board of Cricket Control in India (BCCI) as the governing body controlling the game of cricket in India. In a missive to the BCCI, the cellular operators said that cricket has been played in the country for over 100 years and BCCI is only a `society that organises cricket for profit-making.

The COAI letter comes in the wake of a legal notice sent by the BCCI against cellular operators for offering cricket updates of the ongoing India-England series to their subscribers through SMS. The BCCI notice had also asked operators to refrain from similar activities in future without obtaining prior permission of the Board.

Responding to the BCCI notice, cellular operators said, "Cricket has been played in India for over a century and it is shocking that BCCI can seek to claim property rights over the awareness of the game, and the scores and information on who is batting and who is out, or on so-called "live instant information" or "current events." These are matters that are within the public domain and you cannot claim a right over these. Such a property right has not been recognised by any statute in India."

COAI further added "claims that it is the "central Body for governing and controlling the game of cricket in India" and is "responsible for organising all the international cricket matches to be played in India" were pompous, untrue and denied.

BCCI is a mere society involved in the activity of organising cricket matches for profit. It holds no statutory backing or `central' or exclusive status. Cricket is just a game, and cannot be privatised by BCCI, to the exclusion of anybody."

COAI said that BCCI had been licensing out television rights and audio rights, not as Intellectual Property Rights, but only as rights as the organiser of the event to permit or disallow entry into the stadium with heavy equipment, and to utilise space and infrastructure for the purpose of filming the match or recording the commentary.
